The neo-national prosecutor’s office of Adam Bodnar has filed a request to exclude judge Przemysław Dziwański from examining the complaint against the refusal to apply pre-trial detention to MP Marcin Romanowski. However, as lawyer Bartosz Lewandowski, the MP’s representative, announced today, the Warsaw court did not accept the request. PiS MEP Jacek Ozdoba commented on the matter.
First of all, I would like to remind you that, first of all, the National Prosecutor’s Office is acting without foundation, including the team dealing with the Justice Fund, because this institution was taken over illegally by force. Secondly, the Prosecutor’s Office itself is, on the one hand, an attempt to escape. This is an appeal against the fact that, as confirmed by the Council of Europe, a Member of Parliament who enjoys immunity has been unlawfully deprived of his liberty and his liberty has been restricted by temporary arrest. This is punishable by a prison sentence. And the prosecutors have done this, so you should be aware that today the Prosecutor’s Office and Adam Bodnar are taking steps to arrange the jury, and in this case we see that they have not succeeded.

Naturally, the question arises as to its nature and then its legal and criminal assessment. Is it corruption or other benefits, for example, positions in exchange for a judgment or decision?

I would like to remind you that influencing such decisions is also punishable, i.e. punishable by criminal law. We are witnessing a very dangerous precedent when the Attorney General gives permission to determine the composition of courts, which of course amounts to de facto ordering of sentences.
