Letters were sent to the court stating that the trustee should take over power in the Confederation. This is the result of the inability to convene the party congress on time, Rzeczpospolita reported in Wednesday’s edition, citing documents obtained.
According to “Rz”, Janusz Korwin-Mikke, a former member of the Confederation’s leadership council, who, after being expelled from it, founded the KORWiN group, filed a request with the Warsaw District Court for the appointment of a guardian for the Confederation. The politician claims that “the Southern authorities are illegal.”
He is not the only one. This is the result of the legal situation within the party
– writes “Rz”.
As the newspaper explains, the Confederation, which on July 25 celebrated the fifth anniversary of its entry into the register of political parties by the Warsaw District Court, is supposed to hold its first congress by that date. The party’s statute states that “the congress shall be convened by the leadership council at least once every five years.”
Leadership Council, which includes Krzysztof Bosak, Sławomir Mentzen, Grzegorz Braun and Michał Wawer, did not do so. Reason? Unofficially, it is said that the congress would mark the opening of the Confederation, which has about 90 members. The Confederation is an umbrella party that brings together the Barefoot National Movement, Mentzen’s New Hope and Braun’s Confederation of the Polish Crown, each of which has several thousand members. Within the Confederation, there are fears that competition will arise over which group will enroll more people
– writes “Rz”.
Michał Wawer, a member of the Leadership Council and treasurer of the Confederation, told the newspaper that the Confederation is still in the formation phase, that the authorities were appointed by the founders of the party in 2019, and that the Statute contains a provision stating that “the term of office of the authorities thus appointed lasts until the election of the authorities at the Congress.”
The authorities can take legal action until they decide to convene a congress
– he emphasized.
Another conclusion
As the newspaper discovered, at least one more application has been filed with the court to appoint a guardian for the Confederation. It was filed by three people associated with the Confederation: Samuela Torkowska, Piotr Sterkowski and Tomasz Kwiatkowski. In 1995, the latter was the head of the Chancellery of the President of the Republic of Poland, Lech Wałęsa.
Unlike Korwin-Mikke, they are not members of the Confederation; they claim that they have “the constitutional, statutory and legal right to apply for membership.” In a letter to the court, they state that they cannot become members because, according to the statutes, admission to the Confederation is decided by a vote in the Leadership Council.
– wrote “Rz”.
The newspaper reported that the court had not yet considered requests to appoint a guardian.
