“The Supreme Court ruled in complete isolation from the facts and the extraordinary, unprecedented circumstances of the pandemic. This destroys confidence in the state and paralyzes in the future its bodies that are trying to act in the most difficult moments in recent history! – this is what Marek Pęk, Senator of Law and Justice, wrote on the X website about the rejection of the cassation appeal regarding postal elections by the Supreme Administrative Court.
The senator noted that the Supreme Court judgment does not fully address the issue of the need to hold elections in 2020.
The Supreme Court’s judgment in this case The Preparation of Envelope Elections claims that the decisions were unlawful, but does not address the issue of the need to hold elections at all. In his analysis he ignores the constitutional obligations of state bodies! Despite the introduction of an epidemic in the spring of 2020, public authorities, including the Prime Minister, were obliged under the provisions of the Constitution to organize the presidential elections at an appropriate time. There was no condition excluding this obligation stated in Art. 228 section 7 of the Constitution!
– He wrote.
Judgment from 2023
Marek Pęk reminds us of the verdict of the Warsaw-Śródmieście District Court from November 2023.
Let us remind you: in November 2023, the Warsaw-Śródmieście District Court legally declared that there was no violation of the law in this case: preparatory activities related to elections held during the pandemic cannot be considered as acting to the detriment of public interest. All preparatory activities described in the decisions related to the elections. The decision does not lead to the withdrawal of the powers of the National Electoral Commission/KBW. In the event of inaction of the state authorities in efforts to ensure the security of the presidential elections during the pandemic, accusations of failure to fulfill their duties by these authorities would appear in the public space
– he named.
The Senator for Law and Justice stated that the Supreme Court’s ruling for the Administration could lead to paralysis of state organs in the future.
In summary, the Supreme Court ruled completely disregarding the facts and the extraordinary, unprecedented circumstances of the pandemic. This destroys confidence in the state and paralyzes its organs in the future, which are trying to act at the most difficult moments in recent history!
– he concluded.
