Adam Bodnar begins the battle for the project of changes to the Criminal Code regarding the so-called Hate Speech. A special team will be set up to prepare a strategy for countering hate speech and bias-motivated crimes, and for punishing such acts. The attorney general’s spokeswoman announced the formation of the team on Thursday. A month ago, Minister Katarzyna Kotula announced that the left would ensure that the draft law on the ban on hate speech against minorities is processed and implemented as quickly as possible.
As emphasized by the PG’s spokeswoman, Prosecutor Anna Adamiak, “preliminary proceedings in hate crime cases remain of ongoing importance for the Public Prosecution Service.”
Two prosecutors have been appointed in all district and district prosecutor’s offices to handle cases in this category. In addition, continuous monitoring of cases is carried out in the District and Regional Prosecutor’s Offices and in the Preliminary Investigation Department of the Polish Police, which allows the collection and analysis of material from subordinate units, including data on the forms, clues and dynamics of this type of crime and the modus operandi of the perpetrators.

Proc. Bilewicz on behalf of Bodnar
The analysis and preparation of “assumptions for a systemic, comprehensive and detailed strategy for countering and punishing such behavior” will be carried out by a team of advisors at the GUT, established by Bodnar’s order of June 12 this year.
The team is interdisciplinary and the work will be led by Dr. Aleksandra Gliszczyńska-Grabias – an expert in anti-discrimination law. In addition to the chairman, the team consisted of twelve members: scientists, lawyers, prosecutors and legal advisors. The National Public Prosecution Service will be represented in the team by prosecutor Jacek Bilewicz.
The team will develop new guidelines and instructions to ensure an appropriate response from state authorities in relation to these types of crimes, with particular emphasis on the problem of hate speech on the Internet. It will also prepare a set of good practices and recommendations on methods to counter such behavior

One of the team’s tasks is to identify possible reasons for the lack of an appropriate response to these types of crimes. especially regarding the aspect of the applicable legal system and proposing changes to the law.
In addition, the team, in collaboration with the National School of Judiciary and Public Prosecution, should prepare training materials on this topic for judges and prosecutors.
The team shall submit a report on its annual activities to PG by March 31 of the following year

The order noted, among other things: about the guidelines issued ten years ago – in February 2014 – by then Attorney General Andrzej Seremet regarding hate crimes.
It is worth recalling that the Sejm contains proposals for changes in criminal law regarding the so-called Hate Speech. Similar regulations are already in place in Canada and Scotland. Canadian law is an example of complete censorship of any criticism of the LGBT community. You could even end up behind bars for life. Some believe it is an expression of totalitarianism. In Scotland, perpetrators of ‘hate speech’ will in turn be able to be charged anonymously in a sex shop.
