Can the stories of Tomasz Mraz, former director of the Justice Fund, and parliamentarian Roman Giertych, relating to content covered by the secrecy of the investigation, constitute a crime? According to Giertych and Mraz, this cannot be the case. An expert, namely prosecutor Michał Ostrowski, the legal deputy of the Attorney General, thinks differently. According to him, the ‘stories with strange content’ of both men bear the hallmarks of a crime. He also does not rule out that he will make an appropriate report to the public prosecutor’s office.

The PROSECUTOR is responsible for the investigation and its results. AND NOW, what MRAZ and his lawyer are talking about is (attention) data from the INVESTIGATION. And why? Because the investigation is confidential – a legal introduction. Because such public “stories with strange content” are a CRIME described in Art. 241 of the Criminal Code (note) also of 1997, consisting of publicly, without consent, disseminating information from preparatory proceedings (in this case relating to alleged irregularities in the Justice Fund) before they were made public in legal proceedings

The prosecutor also directly quotes an article from the Criminal Code that, in his opinion, may have been violated by Oraz and Giertych: “Whoever publicly disseminates information from preparatory proceedings without authorization before it is made public in legal proceedings will be subject to a fine, restriction of liberty or imprisonment of up to two years.”
This is a very serious crime against JUSTICE. Who committed the crime? Given Roman G. stated yesterday that the ‘leaks’ come from the National Public Prosecutor’s Office

Presumably, therefore, as a member of the Sejm of the Republic of Poland, as a civil servant, he fulfilled his legal obligation and reported the crime under Article 241 of the Criminal Code, and perhaps also other crimes (e.g. abuse of power by public prosecutors who are “leaking” – Articles 231 of the Criminal Code, 266 of the Criminal Code and others). If he fails to do so, he is also liable for failure to fulfill his obligations

Prosecutor Michał Ostrowski does not rule out reporting the possibility of a crime being committed by the authors of the play starring Tomasz Mróz.
Conclusion: I will report crimes in this case. Unless the Attorney General talks publicly about the details of this case. He has the right to do so (Article 12 of the Public Prosecution Service Act). Of course, Mr Kleks and Mr Koń (he spoke so eloquently about himself – see internet) should be questioned in this matter. The independent Prosecutor will decide on his/her capacity

The performance of both men and Roman Giertych’s contributions on social media indicate that we are dealing with a spectacle designed to make an impact before the upcoming elections. However, it’s worth wondering what will happen to Tomasz Mraz later and whether his current guardians will still need him.
