We charged five people in the Justice Fund investigation; concerns include payment of more than PLN 66 million to an entity that did not meet formal or substantive requirements – announced the spokesperson of the National Prosecution Service, Prosecutor Przemysław Nowak, on Wednesday.
Przemysław Nowak appeared at a press conference where he spoke about the activities of the Public Prosecution Service regarding the Justice Fund.
This case, at least at this time, is not politically motivated. I believe that any prosecutor who had this evidence and filed these charges would have conducted the same searches. These are activities that seem obvious given this material. One can only say that it was politically motivated and that no attempt had yet been made to deal with the matter in a reliable manner. This issue concerns politicians and in that sense has a political life of its own. Politicians are speaking out on this issue. First of all, politicians who were more or less directly responsible for the FS
– he said.
People who speak out are often de facto speaking about themselves, because they were more or less indirectly responsible for this Fund. The case is at a relatively early stage. (…) We have managed to collect extensive evidence. Furthermore, yesterday’s and today’s work has allowed us to supplement this material with numerous documents and data carriers. They will be further analyzed. Thanks to the material we already have, we were able to file charges against five people, and the prosecutor announced the charges against these people. This concerns four officials from the Ministry of Justice from the Justice Fund department and one representative of the foundation
– he argued.
In general terms: three of these four officials, including the director of the Justice Fund Department of the Ministry of Justice, the former director, and two specialists, members of the Competition Commission, have been indicted in connection with the fact that they caused the payment of funds for an amount of more than PLN 66 million to an entity that did not meet the formal or substantive requirements to receive this money
– he said.
He announced that applications for temporary arrest would be submitted
The justification will be the fear of fraud

Waiver of immunities
The PK spokesperson also spoke about the analysis of waiving politicians’ immunities.
All this material (…), supplemented by very extensive material from yesterday and today, will be analyzed in terms of lifting the immunity of politicians

When asked about their names, he replied:
I can not say. (…) Persons responsible for the operation of the Fund.
He then referred to the fact that when Zbigniew Ziobro’s house was searched, the owner was not there.
When someone is at a certain place, he is asked to hand over these items voluntarily. No one is ever informed about the search in advance, because this activity would be pointless. If no one is there, you enter by force. This is the standard. (…) It was categorically established that he was abroad. Contacting him with the intention of searching him and asking him to appear was obviously pointless
– he said.
When asked which MPs he was referring to regarding the possible lifting of immunities, he replied:
I will show the analysis, but, as I said, MPs.
