“We admit that we have applied the law in force in Poland, adopted by the Sejm and signed by the President, and also that we have ignored the advice of Iustitia activists, who in various appeals, like tribunes, have advised us against to obey the law. Such is the wisdom of the fact that with their undisputed authority (supported by numerous expert opinions) they considered them non-compliant with European standards,” the Lawyers for Poland Association emphasized in a statement. This is an ironic response to the Iustitia Association’s call to punish judges of the National Council for the Judiciary, who are called “neo-judges” by lawyers supporting the current government.
The Iustitia Association of Judges demands that the Minister of Justice and Attorney General Adam Bodnar establish criminal and disciplinary liability for judges serving on the current National Council for the Judiciary. The legal community, which supports the current authorities, considers the Council in its current form to be “unconstitutional” and calls its judges “neo-judges”.
Judges must be courageous and principled people. Only such people can defend citizens against abuse. Those who failed the test during the test and chose the side of evil must be held accountable. People like Dagmara Pawełczyk-Woicka, Maciej Nawacki or Rafał Puchalski and other members of the neo-KRS should be punished for this
– argued the President of Iustitia, Prof. Krystian Markiewicz.
“Suspects”, “neo-judges” and “super-prosecutor”
The Lawyers for Poland Association responded with a mocking statement, the signatories of which ironically called themselves “neo-judges” and Minister Bodnar a “super-prosecutor.”
In the statement, the judges apologize and express regret. For what purpose and for what reason?
Statement of suspected judges in connection with Iustitia’s notification of a crime committed by members of the National Council for the Judiciary and other neo-judges, addressed to super prosecutor Adam Bodnar
says the title.
In connection with the notice revealed in the media on March 25, 2024 (one day before the Sejm public hearing on the amendment of the law on the National Council of the Judiciary) that we committed a crime, addressed to an independent prosecutor , the Minister of Justice and a candidate for a Member of Parliament of the ruling party – Adam Bodnar. Through the faithful executors of his political will, i.e. the association of only independent, apolitical, steadfast, law-abiding and European judges of the association Iustitia, we humbly declare that we fully admit our guilt
– we read in the statement.
We admit that we have applied the law in force in Poland, adopted by the Sejm and signed by the President, and also that we have ignored the advice of Iustitia activists, who in various appeals, like tribunes, have advised us against to obey the law. Such is the wisdom of the fact that they, with their own and unquestioned authority (backed by numerous expert opinions), found that they did not meet European standards. We apologize to them for any misconduct we have committed. However, we did not realize that from the moment the cruel authorities shut down such promising careers in the judiciary in 2018, which would last until the third generation, we have caused unimaginable harm to you and your families.
– write Lawyers for Poland.
We unfortunately admit that we were not aware that the rank of the Polish state in the European Union is so high that it is obliged to pioneer and absolutely apply a new source of law, i.e. the judgments of the ECJ EU and the ECtHR, even when the Polish Constitutional Court considers this to be in accordance with the provisions of the Constitution that are not recognized by these tribunals, in particular the provisions of the Act on the National Council of the Judiciary, even when other countries (for example Germany) can repeatedly refuse to apply these through the judgments. of their courts (e.g. the Karlsruhe Tribunal), if these judgments conflict with the constitution of a particular state
– say the judges ironically.
“We will not spare our country and the rule of law.”
Later in the declaration, the signatories ‘admit’ that they treat the Constitution of the Republic of Poland as ‘the basic instrument of self-determination of a sovereign state over European law’, and its interpretation by the Constitutional Court as ‘the ultimate instrument for the protect our legal system and the interests of citizens.”
We have also wrongly opposed the rampant tendency in the case law of international tribunals to extend their powers beyond the Convention, which will certainly be treated as a highly aggravating circumstance. We express our remorse and are convinced that the right to give legal force to this law – the Sejm resolutions that shorten the term of office of the National Council of the Judiciary and deprive judges of their positions – will last forever, and therefore also for future governments, remain an unparalleled model for implementing reform in our country.
– we read in the statement.
At the same time, we apologize to all citizens whose common interest is still the Republic of Poland for our deplorable attempt to take the courts out of the oligarchic hands of members of Iustitia and the like. And finally, we appeal to the future Supreme Court for the Restoration of the Rule of Law (which certainly consists of noble members of Iustitia) to administer us the highest justice. We will not save on the future of our country and the rule of law
– summarizes the authors, signed as judges.
