The National Council for the Judiciary is working on a request to the Constitutional Court questioning the powers of the Minister of Justice with regard to the disciplinary system of judges – Dziennik Gazeta Prawna reported on Monday.
The disputed provisions include – according to ‘DGP’ – also those on the basis of which Adam Bodnar appointed the so-called “ad hoc” spokespersons to verify the previous actions of Piotr Schab, the main disciplinary spokesperson.
The National Council for the Judiciary also wants the Constitutional Tribunal to temporarily ban such spokespersons from taking action and Bodnar from appointing any more people to such positions.

Content of presentation
The draft application was prepared in one of the committees of the National Council for the Judiciary. Its contents were presented by judge Maciej Nawacki at the last meeting, the newspaper reported.
His report concluded that a number of provisions that give the Minister of Justice broad powers with regard to the disciplinary system of judges are contrary to the Constitution.
