“Please tell the truth, the whole truth and nothing but the truth. For every committee and in every case,” Prime Minister Donald Tusk wrote in a response on Platform X, in an address to the President of Law and Justice. These are the words of Jarosław Kaczyński, who emphasized before the Pegasus Investigative Committee that the Prime Minister should release him from secrecy regarding the secret content.
The head of government referred on the X platform to the PiS president’s statement during the hearing before the Pegasus investigative committee.
Apparently President Kaczyński is waiting for my permission to testify. So please tell the truth, the whole truth and nothing but the truth. For every committee and in every case. I allow it
– wrote Donald Tusk.
Testimony from the President
Jarosław Kaczyński testified before the parliamentary investigative committee on Pegasus on Friday. However, he took an incomplete oath because – as he explained – the committee did not have the Prime Minister’s permission to release him of classified secrets. He left out the part of the promise: “Hide nothing from what I know.”
The head of PiS drew attention to one of the provisions of the Investigative Committees Act (Article 11e), which sparked discussion during the hearing.
It states that the person being interrogated should not reveal classified secrets, i.e. secret and top secret, the highest classifications, unless there is appropriate permission from the authorized person. In this case, the competent person is the Prime Minister. That is why I ask the committee whether this permission has been granted to the committee
– he said.
The question was also echoed by PiS club member Jacek Ozdoba, who turned to committee chair Magdalena Sroka (PSL-Trzeci Droga).
If a formal request is made today to close the committee meeting and provide confidential answers, the meeting will take place behind closed doors.
– Magpie replied.
Prime Minister’s approval
She also added that she was not obliged to ask the Prime Minister for such a request, so there is no such letter, and tried to continue the meeting.
I must take an oath here, in accordance with the rules governing the functioning of the committee. There is a formula in this promise that I must tell everything I know. The part of my knowledge of Pegasus that can be treated as secret or even top secret is minimal, you might even say marginal. Well, if I’m going to tell the whole truth, I can’t make such a promise
– explained Jarosław Kaczyński.
Sroka tried to explain that the committee did not want to expose Kaczyński to the risk of breaching confidentiality and that if his answer contained secret content, he would be relieved from answering.
The PiS president replied that he was obliged to obtain the exemption.
I cannot swear here that I will tell everything I know (…), because I cannot say everything I know and this kind of documents in the form of an exemption – I don’t think the current Prime Minister will do anything about it have difficulty with it – it must be spoken out if I want to tell the whole truth, or I take an oath with the condition that I only say what I can say
– he emphasized.
Prime Minister Tusk commented on Jarosław Kaczyński’s words and gave his consent to the experience on social media. The head of government jokes about the law. Instead of issuing an official document, it responds to the president of PiS – summoned before one of the parliamentary committees – on platform X. Tusk’s government, after replacing laws with resolutions, has turned to issuing regulations and regulations for social media?
Furthermore, will the PiS president read his message “Please only tell the truth” on platform X if he does not have an account there? Will the Pegasus Commission of Inquiry make any comment on the Prime Minister’s statement? Furthermore, is Tusk aware that his agreement to tell “the whole truth and nothing but the truth before every committee and in every case” could backfire on him?
Comments
There were comments on social media referring to the Prime Minister’s post.
General permission from Twitter to say anything, anywhere. Clauses, secret information, formalities, state interests do not exist. This contribution perfectly illustrates Donald Tusk’s attitude towards the Polish state in general and the rule of law in particular. P.S. I wonder if Witold Zembaczyński et al. will now invoke the Twitter permission in committee?
We know that you are not entitled to anything because you are acting “in a state of extreme necessity” and “looking for a legal basis”, but: this consent is given in writing, not in a tweet; it must be requested by the Commission. It is astonishing that you, as Prime Minister of the Republic of Poland, should so blatantly ignore Polish law
Just a social media post, but generally a summary of the current government’s approach to the state and public affairs. On the X website, Mr Donald Tusk ‘releases’ the former Deputy Prime Minister from the obligation of confidentiality during the hearing before the Commission of Inquiry. Shame. In many areas…
