Mateusz Morawiecki (PiS) ruled that if the draft resolution on the Constitutional Tribunal is adopted, it will be an attack on the Constitutional Tribunal and “the highest act that violates the foundations of the rule of law in Poland.” No serious government will recognize such actions in the future, he said.
On Monday, Justice Minister Adam Bodnar and representatives of all parties in the ruling coalition presented the assumptions of projects related to the comprehensive reform of the Constitutional Court during a press conference in the Sejm. Shortly afterwards, a package of four projects was placed – a resolution of the Sejm, two laws (on the Constitutional Court and provisions introducing the Law on the Constitutional Court), as well as a law amending the Constitution of the Republic of Poland. on the website of the Ministry of Justice.
The published draft resolution concerns – as stated in the title – “eliminating the consequences of the constitutional crisis of 2015-2023 in the context of the activities of the Constitutional Court”. In the draft, the Sejm of the Republic of Poland calls on the judges of the Constitutional Court to resign and thus join the process of democratic change. “Taking into account decisions of the Constitutional Court issued contrary to the law may be considered a violation of the principle of legalism,” we read in the proposal.
Earlier on Monday, former Prime Minister and PiS Vice President Mateusz Morawiecki commented on the announced draft resolution during a press conference.
If it were to be passed – although I do not want to believe that it will be passed – it would mean that an act of a much lower rank than the Constitution or statute would operate across and without the consent of acts of a higher rank.

As he said: “If such an attack on the Constitutional Tribunal takes place, it will be an act of the highest order that violates the foundations of the rule of law in Poland.”

According to him, “the precedents set by those in power today are extremely dangerous for our country.”
Every subsequent government will be able to enter the office where a president or chairman is serving a term by law and say: walk away, you don’t like it.

Minister Bodnar announced that the debate in the context of the resolution on the Constitutional Court will take place in the Sejm on Wednesday. According to the Ministry of Justice, “the Constitutional Tribunal headed by Julia Przyłębska has lost any ability to adjudicate constitutional disputes pending before the Tribunal in an apolitical manner.”
In implementing political directives, he lost sight of the Constitution of the Republic of Poland and the resulting principles and norms, which he should absolutely follow. TK has become organizationally dysfunctional
