“The reason why I am making a statement (…) is to treat me as a common criminal,” Michał Ostrowski, Deputy Attorney General, wrote in a statement. “The decision to impose a disciplinary measure is accompanied by an instruction, according to which I, as a suspect, am obliged to undergo a body inspection, fingerprinting, psychiatric examinations, examinations involving procedures on the body, in particularly the collection of blood, hair or body secretions, and the taking of a swab.” of the buccal mucosa,” he added.
Deputy Attorney General Michał Ostrowski announced that he received a decision to file disciplinary charges against him at the end of February. He reported that instructions had been given to him at the same time as this decision which, in his opinion, were inadequate to the charges; called for their withdrawal.
Clues that should arouse surprise
In late January, the Justice Department announced that the department’s head, Adam Bodnar, had appointed a Justice Department disciplinary spokesperson to handle the Ostrowski case from among the candidates identified by Acting National Prosecutor Jacek Bilewicz; it is about questioning the powers of the Minister of Justice and the Attorney General. As the ministry added at the time: “Another possible criminal offense is also publicly questioning the authority of the Attorney General as the main body of the public prosecutor’s office.”
In connection with the ongoing proceedings against me conducted by the ad hoc disciplinary ombudsman Andrzej Janecki, I would like to inform you that in the last days of February I received by post a decision to file disciplinary charges against me. This correspondence also contained instructions for the suspect that, given the facts of the case, had to be astonishing.
– Ostrowski wrote in a sent statement, among other things: PAP.
As he emphasized, the disciplinary proceedings are conducted in secret, so he cannot inform the public about the charges brought against him.

I can only emphasize that the accusations concern the actions I took in connection with the situation at the prosecutor’s office, about which I informed the public widely and transparently through the media.
– He wrote.
According to Ostrowski, taking these actions was his duty as a prosecutor and he has nothing to blame himself for.
A conscious attempt at humiliation
However, the announcement of the charges against me is not the reason why I am making this statement. This reason is to treat me – the current Deputy Prosecutor General, who has publicly expressed legal opinions and taken procedural measures, such as in the case of prosecutor Bogusława Zapaśnik – as a common criminal. The decision to file a disciplinary charge is accompanied by an instruction, according to which I, as a defendant, am obliged to undergo a body inspection, fingerprinting, psychiatric examinations, examinations involving procedures on the body, in in particular the collection of blood, hair or body secretions and taking a swab of the body and buccal mucosa
– wrote Ostrowski.

He ruled that such instructions in disciplinary proceedings are adequate in situations where parallel criminal proceedings are pending against prosecutors and when the specific nature of the evidence in the case requires such activities to be carried out. As he said, his case was not one of them.
Such an action by the ad hoc disciplinary prosecutor can be interpreted as a conscious attempt to humiliate me, especially since the architects of the attack on the prosecutor’s office have made several statements that can be interpreted as threats announcing the possibility of criminal prosecution of prosecutors defending the law. . If this were the case, it should be regarded as an action appropriate for representatives of the public prosecutor’s office in one of the countries beyond our eastern border, and not in the Republic of Poland.
– Ostrowski emphasized.
He assured that he would defend his rights in the ongoing disciplinary proceedings. He also called on ad hoc disciplinary spokesman Andrzej Janecki to withdraw the “completely inadequate instruction”.
Ostrowski emphasized that he also expects Attorney General Adam Bodnar’s response to the situation – “especially in light of the former Ombudsman’s well-known sensitivity to human rights and the norms of a democratic state.”
