On January 26, during the meeting of the Investigative Committee, D. Joński informs that the Public Prosecution Service has received files of ongoing cases – and admits that they are still covered by the secrecy of the investigation – and that the Public Prosecution Service has not agreed with the public use of the information contained therein. Neither about the content of the protocols, nor about who was interviewed, when and in what capacity

Three weeks pass. It’s February 16. The files remain confidential. And Dariusz Joński gives an interview to Fakty TVN. And he explains who was interviewed during the investigation and when. He immediately says that he knew nothing about it before – and the journalist emphasizes that this knowledge comes from the files that Joński received from the prosecutor’s office.

Article 241 § 1 Criminal Code Anyone who, without permission, publicly disseminates information from preparatory proceedings before it is made public in legal proceedings, shall be punished with: • a fine, • the penalty of restriction of liberty, or • a prison sentence of up to two years.
In this situation, as a former member of this committee, I will recommend that Mr Joński be excluded from it – it is difficult to imagine that he could objectively direct its work while risking criminal liability himself.
