The draft amendments to the Criminal Code are already ready. “The idea is to add gender, sexual orientation or gender identity to the existing causes of hate crimes (race, nationality, religion),” reports radio TOK FM. The State Secretary of the Ministry of Justice confirms in an interview with the radio station that “the project is practically completed” and wants it to be submitted to the House of Representatives at the beginning of March and April.
A draft amendment to the Criminal Code will be submitted to parliament around March and April, in which criteria such as ‘gender, sexual orientation, gender identity’ will be added to the existing causes of hate crimes (race, nationality, religion).

We have already practically completed the project. Now it will be sent for inter-ministerial consultations
– confirmed State Secretary of the Ministry of Justice Krzysztof Śmiszek in an interview with the radio station, noting that “the entire LGBT community is waiting for this change.”
The past eight years have been filled with harassment and hate speech against people in our community. It hurt when perpetrators chose sexual orientation or gender identity as a criterion for intimidation, hatred and contempt.
– said the politician, largely manipulative. Recently the slightest criticism, the simplest explanation that, for example, support for same-sex “marriage” does not fit into one’s worldview or religion, or – that there are two genders: female and male. As for the so-called “equality parade”, most of the people who criticized these types of events were not so much disturbed by the sexual orientation of their participants, but by some of the actions they took, for example the increasingly frequent attacks on Catholics and the insulting their religious symbols.
Now – like other racist or xenophobic crimes – crimes based on homophobia or transphobia will also be prosecuted ex officio and treated as racist hate speech.
– said Śmiszek.
The question is what will be considered crimes based on ‘homophobia and transphobia’ – for example the mere assertion that there are only two genders or that two men – at least in the eyes of the Catholic Church – will never marry?

Changes in CT?
Śmiszek was also a guest of Dominika Wielowieyska on today’s “Tok FM Morning”. The journalist asked, among other things: for a resolution on the Constitutional Court and pressure on the ruling coalition to accelerate its preparation.
There is no resolution on the Constitutional Tribunal at this session of the Sejm, but Minister Bodnar announced yesterday that we are in fact polishing the final details of this text. This is an important text, it is not so easy, to say it very clearly, put forward a resolution and see what will happen
– emphasized the Deputy Minister of Justice.
When asked about the disagreements between the coalition partners, Krzysztof Śmiszek replied:
I would rather say that these are gaps that we want to refine and close. Currently these are ‘cosmetic and retail’ differences.
The resolution will be comprehensive – it must be comprehensive. There is no major difference of opinion about the merits. We have an absolutely pathological situation in CT. We have TK, which in recent days has become a kind of ‘fast food’, where you come, put out your hand, get a stamp and leave

A resolution must and will be adopted expressing the will to take further legislative action

We heard last December that the resolution was merely an “expression of the will,” just before the attack on public media. From the representatives of the December 13 Coalition, such statements do not bode well.
