The draft changes to the constitution, prepared by PSL and announced by Prime Minister Donald Tusk, will be considered by the Sejm Commission; they will be analyzed there and it will certainly end with a coherent idea for changes – PSL MPs emphasized in an interview with PAP.
Tusk and Kosiniak-Kamysz want a constitutional amendment. TK in the background
Prime Minister Donald Tusk announced on Tuesday that work in an inter-ministerial team at the initiative of Justice Minister Adam Bodnar has begun and will result in a proposal for a simple constitutional amendment.
This change must be tailor-made to save the foundations of the legal order, for example through elections for the Constitutional Court that are recognized by everyone.
– said Tusk.
The Deputy Prime Minister, Head of the Ministry of National Defense, and President of PSL Władysław Kosiniak-Kamysz also spoke about changes in the Constitution.
A new chapter of the constitution on the Constitutional Court is needed. We will send these proposals to all parliamentary groups
– said the leader of the People’s Party in mid-January.
The Deputy Prime Minister explained that the changes he wants to make to the Constitution are mainly a new chapter regarding the Constitutional Court.
Choice by a different majority – I think 3/5. I would continue to operate a system in which the length of judges’ terms of office is ‘bookmarked’. During the first term, we would choose some for a longer term, others for a shorter term
– he said. He added that this would mean zeroing out the current team’s tenure.
Ultimately one project?
PAP asked PSL MPs whether after these announcements there will be two projects related to constitutional changes – PSL and one from the government – or if there will be one.
The head of the PSL-TD club, Krzysztof Paszyk, stated that “both cases are certainly aimed at one goal, which is to improve the situation and heal the Constitutional Tribunal.”
We have our own idea and a second idea will be developed at government level, the most important thing is that it has one purpose
– Paszyk noted.
When asked if one project would ultimately be created, the PSL MP said that “a constitutional amendment requires these projects to be considered in committee.”
It will be analyzed there and will certainly end up with a coherent idea for changes
– said Paszyk.
When asked if the PSL project was ready, the party politician said it was nearing completion.
Another PSL MP, Jarosław Rzepa, told PAP that he thinks one project will eventually emerge. He also pointed out that “when it comes to these changes, the chances in the Polish parliament are slim,” because – as he said – “we should have a majority, which we don’t have today.”
According to him, “this dualism, which is beginning to function in many areas of the legal system related to the Constitutional Tribunal or the National Council for the Judiciary, means that we must finally reach a compromise.”
Because it is very dangerous for the functioning of the state
– said Turnip.
The law amending the Constitution shall be adopted by the Sejm by a majority of at least 2/3 of the votes in the presence of at least half of the legal number of deputies, and by the Senate by an absolute majority of votes in the presence of at least half of the legal number of senators.
It is scary to fear what constitutional changes Donald Tusk, PSL and the rest of the coalition will propose on December 13. First, they could try to respect the Constitution. Because the words about ‘compromise’ and ‘legal order’ sound like a terrible joke in their mouths.
