“The only institution that can realistically be said to issue judgments based on the Polish Constitution is the CJEU,” Katarzyna Lubnauer said on Radio One. In this way, the Deputy Minister of Education tried to justify the actions of Adam Bodnar and Donald Tusk, who committed lawlessness.
Lawlessness of Tusk’s government
Let us not forget that just after the coalition led by Donald Tusk took power, Bartłomiej Sienkiewicz’s usurpers entered the public media, and the legal basis was… a resolution of the Sejm. Public media, including regional Polish radio stations, were declared bankrupt.
Adam Bodnar, formerly the Ombudsman and now Minister of Justice, is also trying to establish his own illegal order. Bodnar is trying to illegally remove National Prosecutor Dariusz Barski from office and appoint Jacek Bilewicz, Acting National Prosecutor, to a position unknown in the legal system.
Bodnar takes increasingly strange actions to make the job of prosecutors who disagree with his methods more difficult. Proc. Michał Ostrowski announced that Bodnar had banned PG deputies from entering the National Public Prosecutor’s Office building until March 15.
Bodnar also issued an order that changes the organization of the work of the National Public Prosecutor’s Office. As the PG’s deputies emphasized, this has “legal flaws” and a “destructive impact” on the functioning of the prosecutor’s office.

Lubnauer’s absurd translations
Katarzyna Lubnauer, deputy minister of education, tried to explain the lawlessness of Tusk and Bodnar in the first program of Polish radio. She stated that… the CJEU makes rulings on the basis of the Polish Constitution.
Let’s be clear: there is no legal dualism. There is a law, i.e. what is the constitution, what flows from this constitution. This also follows from the CJEU rulings, as they have in fact led to such a situation that the only institution that can realistically be said to make rulings on the basis of the Polish Constitution is the CJEU. Why did this happen? Because the first thing PiS attacked was the Constitutional Court
– argued Lubnaier.
Let’s see what the separation of powers looks like according to PiS. How does PiS experience the legal system in general? The separation of powers means that they have divided themselves in this way: Jarosław Kaczyński is friends with Ms. Julia Przyłębska, President Duda is Ms. Manowska’s companion and colleague, i.e. the first President of the Supreme Court. However, Mr Ziobro has Mr Barski, until recently national prosecutor, who was a witness at his wedding. That is why they set up institutions that had to monitor the law in Poland, which had to be independent and also keep an eye on the authorities. They made organs that were simply familiar to them
– Lubnauer continued her argument.
Does Lubnauer not remember the actions of PO, which lost power in 2015? Does he want institutions to operate on the basis of a resolution of the Sejm, which is not a source of law, because the Tusk government cannot find any other basis?
