Mariusz Kamiński and Maciej Wąsik will not take their seats in the Sejm Hall because they are not members of parliament from the moment the court issued a verdict and ruled that they were criminals – said Włodzimierz Czarzasty, deputy chairman of the Sejm. He emphasized that he would support Marshal Szymon Hołownia on this issue.
On Tuesday, the Minister of Justice, Attorney General Adam Bodnar, transferred court files related to the pardon proceedings against Maciej Wąsik and Mariusz Kamiński to President Andrzej Duda. According to the ministry, a request not to exercise the right to pardon was attached to the file, together with the position of the Attorney General. It was noted that the Attorney General’s opinion is not binding on the President. The KPRP announced this. The president will make a statement at 5:30 p.m.
Tzarzasty, speaking to journalists in the Sejm, noted that the president did not want to use his pardon powers.

When asked what if Mariusz Kamiński and Maciej Wąsik, after being pardoned, appear in the Sejm and want to take a seat in the debate hall, he replied: “They will not take a seat in the Sejm hall because they are not members of parliament at the moment the court made a (final) judgment and declared that they were criminals, adding that the chairman of the Sejm, Szymon Hołownia, has his support in this matter.
When asked whether both politicians would be allowed into the Sejm building, Czarzasty pointed out that “such a procedure does not exist and it does not need to be introduced, so they would not be able to enter the building.”

He added that the governing coalition is prepared for a possible blocking of the parliamentary stage by PiS parliamentarians.

Speaking to journalists in the Sejm, the head of the Poland 2050 club assessed Minister Bodnar’s decision as good.
These are very serious crimes involving fabrication of evidence. In a democratic state governed by law, these types of crimes, especially those committed by representatives of the political class, must be condemned with all the force.

In my opinion there is no reason for pardon. I would recommend to the President exactly the same as Minister Bodnar

According to Michał Szczerba, a member of parliament from the Citizens’ Coalition, “the opinion of the Attorney General is clearly negative.”

It was an abuse of power and it must be spoken about directly. It was incitement to corrupt behavior, it was falsification of documents, it was surveillance of people who were guilty before God. These are all official crimes, abuses of power for political purposes, and we need to talk about them very directly. The idea was to destroy (then Deputy Prime Minister, Minister of Agriculture, Head of Samoobrona) Andrzej Lepper and take over his political environment

According to Szczerba, in the case of forgiving Kamiński and Wąsik, the president “escalated the conflict and escalated the emotions.”
These public meetings in front of prisons are the result of President Duda’s immature actions

The case of Maciej Wąsik and Mariusz Kamiński
The former head of the CBA and former Minister of the Interior, Mariusz Kamiński, and his former deputy, Maciej Wąsik, were sentenced to two years in prison by final judgment on December 20 last year for abuse of power as former head of the CBA – in connection with the so-called 2007 land scandal
On January 9, they were detained and then placed in jail.
On January 11, the President announced the start of pardon proceedings against Kamiński and Wąsik under the Code of Criminal Procedure. He also asked the Attorney General to suspend the execution of the sentence and release them from custody for the duration of the pardon proceedings.
There are differing legal opinions on whether Mariusz Kamiński and Maciej Wąsik will still be parliamentarians if they are released from prison on a presidential pardon. However, as you can see, the deputy chairman of the Sejm, Włodzimierz Czarzasty, already assumes that both politicians will not keep their seats in parliament and calls them ‘criminals’.
