Foreign Minister Radosław Sikorski has decided to terminate the validity of the letter of intent regarding the complaint to the ECtHR against Russia in connection with the Smolensk plane crash, the Ministry of Diplomacy announced on Monday.
The ministry announced in a statement on Monday that the head of the Ministry of Foreign Affairs, Radosław Sikorski, “issued a statement not continuing cooperation and thus terminating the letter of intent signed by the then government on October 10, 2023 .” Minister of Foreign Affairs Zbigniew Rau, then Chairman of the Subcommittee for the Re-investigation of the Antoni Aircraft Accident Macierewicz and Mr Ben Emmerson, lawyer representing Emmerson Consulting International Ltd. represents.

The Foreign Ministry noted that the letter was signed just before the parliamentary elections “despite serious reservations about the effectiveness of the chosen operating model.”
In the Letter of Intent, the parties declared their willingness to cooperate in the preparation of an interstate complaint against Russia before the European Court of Human Rights “in connection with an aerial incident involving the Tu 154 M aircraft over the Smolensk Siewierny airport in the territory of the Russian Federation on April 10, 2010”

The Ministry of Foreign Affairs has noted that one of the parties to the Letter of Intent has ceased to exist due to the dissolution of the Aircraft Accident Reinvestigation Subcommittee by decision of the Minister of National Defense of December 18, 2023.
In this situation, the Secretary of State informed lawyer Ben Emmerson about the termination of the letter of intent and withdrawal from its implementation. At the same time, the Head of Diplomacy thanked Mr. Emmerson for his willingness to cooperate with Poland and for his other activities aimed at protecting human rights in the international arena.
