The change in the position of the National Public Prosecutor’s Office is an attempt to extensively circumvent the applicable regulations. The recognition that Dariusz Barski never held this position brings with it the possibility of questioning all procedural decisions – said Małgorzata Paprocka, minister at the KPRP, in the PAP Studio.
Paprocka ruled in the PAP Studio – referring to the decision to change the position of the National Prosecutor – that these were ‘attempts at far-reaching circumvention of the applicable regulations, whereby the intervention of Minister (Justice Adam) Bodnar in this case was based on the fabricated idea that Mr. Dariusz Barski never held this position.
According to the presidential minister, such a position brings with it the possibility of questioning all procedural decisions made by Prosecutor Barski over the past two years.
We cannot take into account such serious consequences for the functioning of the justice system as the possibility of, for example, challenging arrests or charges brought by the public prosecutor. Let’s be serious about the consequences of this kind of playing with the law. The president clearly says: “you won the election, you have the right to make changes, but do so in accordance with the applicable regulations.”

No competition formula
When asked about Bodnar’s announcement to hold a public competition for the position of the new National Prosecutor, she replied that the applicable law – Law on Public Prosecution does not provide for a competitive formula.
Today, in accordance with the law, the National Prosecutor is appointed by the Prime Minister, at the request of the Attorney General, after seeking the advice of the President

When asked, she said that she did not rule out the possibility of selecting candidates for the National Public Prosecutor’s Office with the participation of prosecutors in a competitive procedure, but emphasized that this would require a change in the law.

President Andrzej Duda has submitted an application to the Constitutional Court regarding the dispute over powers between the President of the Republic of Poland, the Prime Minister and the Prosecutor General. The President and PiS politicians claim that Dariusz Barski is still the National Prosecutor, while the Minister of Justice, Attorney General Adam Bodnar and the ruling coalition believe that Barski never effectively took his position, and the acting National Prosecutor is Jacek Bilewicz , appointed by the Prime Minister.
