““Even if they are in prison, the president will not pardon them a second time because he effectively pardoned them in 2015,” Presidential Minister Marcin Mastalerek said on the “Rymanowski Breakfast” program on Polsat News and Interia.
The guests of the “Rymanowski Breakfast on Polsat News and Interia” were: Marcin Mastalerek (Chancellor of the President), Barbara Dolniak (KO), Piotr Zgorzelski (PSL-Trzecia Droga), Anna Maria Żukowska (left), Radosław Fogiel (PiS ), Krzysztof Bosak (Confederation). The topic was the case of MPs Mariusz Kamiński and Maciej Wąsik.
“They don’t care if we have order or not.”
Left MP Anna Maria Żukowska assessed the situation as “legally very complicated” and probably difficult to understand for the average viewer.
This is the result of eight years of destruction of the rule of law by PiS –
– said the politician, noting that “there is still a chance to save the parliamentarians” – the president could pardon Kamiński and Wąsik now, after their conviction.
According to the deputy chairman of the Sejm, Krzysztof Bosak, the Polish authorities must “comply with the rulings”.
First of all, we cannot allow ourselves to be dictated to from abroad by someone who tells us which state institution exists and which does not
– said the Confederation MP. According to Bosak, this “pushes” Poland into “anarchy”
And who pushes us into this? People from Luxembourg, Brussels. They don’t care whether we have order here or not
– he said.
“They can enter the Sejm like any other citizen.”
According to KO MP Barbara Dolniak, the entire situation is “clear and precise” and the final judgment is valid and enforceable.
When the final judgment is pronounced, the gentlemen are no longer Members of Parliament and cannot enter the plenary hall.
– she added.
The situation is also not complicated, according to the deputy chairman of the Sejm, Piotr Zgorzelski.
Kamiński and Wąsik were legally convicted by the court of committing abuse of power, which consisted of incitement to corruption. This is the crux of the matter. This judgment is final
– he pointed out.
The PSL-Trzeciej Droga MP also pointed out that Wąsik and Kamiński “lost their passive right to vote at the time of the final verdict”. –
They can enter the Sejm like any other citizen. But are they allowed to participate in the vote? In my opinion no
– he said.
Imprisonment for fighting corruption?
Marshal Bosak says the obvious, and KO politicians disagree, is that the CJEU has no right to hear legal cases in Poland. The Chamber of Extraordinary Control is legal. According to what appears in the media, within a few days this chamber will announce that the parliamentary elections in Poland were legal and will confirm that you are the government. And then what? Do you mean to say that this is not a court and that we are not a government?
– said the head of the President’s Office, Marcin Mastalerek.
He assessed the recent conference of Sejm Chairman Szymon Hołownia as a “black day” in his political career. Why?
This is the day when Marshal Hołownia experienced and realized that the Sejm is not a Sejmflix, that these are serious matters, that serious decisions need to be made. I am convinced that this will be a dark day in his political career
– said Mastalek.
The right to pardon arising directly from the Constitution is the exclusive domain of the president, who applied this right to pardon in 2015. This should put an end to the matter for both ministers. The subsequent actions, the entire process that continued despite the pardon, should not have happened.
– said PiS parliamentarian Radosław Fogiel.
The head of the Office of the President of the Republic of Poland pointed out that the 2015 pardon was legally valid.
Even if [Wąsik i Kamiński] will be in prison, the president will not pardon them a second time because he successfully pardoned them in 2015
– he emphasized.
The President believes that he committed this act and that the President’s prerogatives should not be questioned. Because once the head of state agrees to question some of her prerogatives, they will later be questioned elsewhere.
– Marcin Mastalerek added.
There are people who doubt that Kamiński and Wąsik should be pardoned. The president pardoned them, but if we translate this into politics, it is an extremely dangerous signal that people who fought corruption, and corruption in all groups, should go to prison.
– he assessed.
I believe that the Polish state cannot send such a signal. People who fought corruption are going to jail, we hear from PO that the Central Anti-Corruption Bureau will be liquidated…
– pointed to the presidential minister.
For years, generations of Poles have laughed at the scene in which Mrs. Pawlak hands her son grenades and says: the court is the court, but justice must be on our side. And this is precisely the attitude of the countries in the current ruling coalition
– said PiS MP Radosław Fogiel, addressing the representatives of the current parliamentary majority.
