The National Association of Judges “Judges of Poland” has adopted a resolution in defense of freedom of expression. Below you will find its contents.
National Association of Judges “Judges of the Republic of Poland”, based in Kraków, whose exclusive legal purpose is the generally understood well-being of the legal system, based on the principle of apoliticality, guided by concern for the democratic foundations of the state and the protection of freedom of expression and the right to freedom of expression, which are based on the provisions of the Constitution. , expresses concern about actions against media pluralism

In connection with recent events regarding the situation in the public media, we would like to point out that freedom of expression is the basis for the existence of democracy. Every citizen has the right to express his or her own views, even if they are controversial in the media, and this right cannot be taken away or limited in any way.

We believe that all legal disputes should be resolved through legal proceedings before an independent judge, based on applicable provisions: Art. 27 and 28 of the law of 29 December 1992 on broadcasting (consolidated text: Official Gazette of 2022, item 1722, as amended), Art. 8 and 9 of the Act of 31 July 1997 on the Polish Press Agency (Journal of Laws, No. 107, Item 687, as amended, the Act of 22 June 2016 on the National Media Council (consolidated text: Journal of Laws of 2021) r .item 692), and not through extralegal activities

The resolution drew attention to the recent decision of the Constitutional Court, according to which it was ordered to refrain from making changes in the authorities of the public media.
We also draw attention to the content of the ruling of the Constitutional Court of 14 December 2023 in case K 29/23 on the granting of security, which ordered no changes to be made to the composition of the bodies of public radio and television broadcasters to the request of members of the Sejm of the Republic of Poland for an investigation into constitutional compliance with the provisions of the Broadcasting Act

Any actions not supported by legal provisions threaten the internal security of the Republic of Poland and, above all, undermine the credibility of the Polish state in the international arena as a constitutional state.

For the sake of such priceless values as human life and health, as well as the sense of human dignity, we appeal to people to exercise moderation in expressing their opinions and refrain from using physical force to settle any disputes to solve. We also oppose the removal of historically significant programs and materials from public media sources. Such actions cannot be called anything other than censorship, which is unacceptable in a democratic country.
