Adam Bodnar he told us everything we need to know in the current situation. The law does not apply, the hierarchy of sources of law does not apply, the constitution is not valid. Political will is needed:
We have a situation where we are restoring this constitutionality and looking for a legal basis to do so. (…) I believe that the legal basis resulting from the Commercial Code and the ownership situation in the context of Polish television or Polish radio is sufficient to implement these changes –
– said Bodnar – currently Minister of Justice – on Radio Zet. And to the presenter’s comment that as Commissioner for Human Rights he has clearly indicated that no minister can appoint TVP bodies, the minister replied:
“Madam Editor, please take this into account what was the situation. It was 2016when there was hardly any change in the public media” –
– and then he started digging into his interpretation of the events of years ago.
The law does not apply in other areas, as noted by former Minister of Culture, PiS MP Piotr Gliński. Important contracts and agreements are broken, people are thrown out without regard to the terms of the contracts concluded with them.

Sienkiewicz and Hołownia will go down in the history of Polish democracy as the creators of an important precedent. This is a precedent the government’s rejection of the systemic rules of the game, founded to prevent the political struggle from turning into a free-American struggle. Its importance, which is difficult to overestimate, is that the competition continues, but without rules.
The team that returned to power under the slogans ‘rule of law’ and ‘democracy’ it destroyed democracy and the rule of law. She even gave up the hypocrisy, as Adam Bodnar clearly said: first the goal, then looking for legal cover, and if there is no cover, looking for the police and secret services. This will stay with us for a long time.
The situation is clear: If the independence camp returns to power – and today it is already clear that it will return – it will have to rebuild not only Polish independence, but also democracy and the rule of law.
