This is the prosecutors’ response to the shocking practices of Adam Bodnar, who rejected the entire apolitical composition of the National Council of Prosecutors (KRP), an advisory body to the Attorney General. The special resolution of the meeting of prosecutors of the National Prosecutor’s Office emphasizes the illegality of the decision of the Minister of Justice and is an act of courage by independent investigators.

Meeting of prosecutors of the National Public Prosecutor’s Office, acting in accordance with art. 45. Law 2 of January 28, 2016, Law on Public Prosecutions, expresses its opposition to the actions taken by the Attorney General regarding changing the composition of the National Council of Prosecutors during the current term of office. On December 15, 2023, the National Public Prosecution Service received letters from the Attorney General regarding the dismissal of the National Public Prosecution Service from the National Public Prosecution Service, Dr. Czesław Klak, retired Prosecutor of the National Public Prosecution Service, Dr. Grzegorz Ocieczek, Prosecutor of the National Prosecutor’s Office Beata Sobieraj-Skonieczna, Prosecutor of the National Prosecutor’s Office Michał Ostrowski and Prosecutor of the National Prosecutor’s Office Adam Zbieranek. The legal basis was indicated by the Attorney General, Article 42, § 6, point 4, of the above-mentioned law. Taking into account the foregoing, the Meeting of Prosecutors of the National Public Prosecutor’s Office determines that the above-mentioned The prosecutors of the National Public Prosecutor’s Office have not produced any legal consequences, that is to say, they have not actually been dismissed from the Council, because the legal basis indicated by the Attorney General does not apply to the members of the Council appointed therein. As a result, the “new” five prosecutors were not legally appointed to the Council, as there was no vacancy allowing such a decision to be made.

Adam Bodnar was convinced that the prosecutors of the Public Prosecution Service would accept all his decisions without a word. He made a serious mistake and independent investigators deserve respect.
