The Government has decided to suspend the approval of Polish applications for the post of Judge of the Court of Justice of the European Union for the term 2021-2027 and for the post of Judge of the General Court of the European Union for the term 2022-2028 Pull. has informed the Prime Minister’s Chancellery.
As announced in a statement after the meeting, the Council of Ministers decided to approve the candidacy of Dr. Hab to withdraw. Dobrochna Bach-Golecka for the office of Judge of the Court of Justice of the European Union for the term 2021-2027 and the candidacies of Judge Aleksandra Rutkowska and Dr Hab. Arkadiusz Radwan for the post of Judge at the General Court of the European Union for the term of office 2022-2028.
Reasons for the government’s decision
In the cabinet’s opinion, the competitions in which the above-mentioned candidates were selected did not meet the requirements that should apply to such important positions.
The candidates were interviewed quickly; all interviews were conducted in a very short time, in one day. Furthermore, the competition team consisted almost exclusively of people who are not experts in European Union law, in particular the case law of the Court of Justice of the EU. As a result, the substantive aspects could not be sufficiently taken into account in the team’s decisions
– indicated in the announcement.
The CJEU consists of 27 judges – one from each Member State.
The General Court of the European Union is a tribunal that functions as the Court of First Instance. It consists of two judges from each Member State.
