“President Andrzej Duda’s act of mercy towards Mariusz Kamiński and Maciej Wąsik still has its force. They have not lost their seats in parliament,” argues lawyer and PiS MP Marek Ast.
Today, Marshal of the Sejm Szymon Hołownia took decisions on the expiry of the parliamentary mandates of Mariusz Kamiński and Maciej Wąsik. The information was provided on the parliamentary profile on the X platform.
Ast: The presidential act of clemency still has its power
According to Asta, President Andrzej Duda’s 2015 clemency law still applies to Kamiński and Wąsik.
In my opinion, the act of mercy still has its force, the gentlemen have not lost their seats in parliament, but whether they are allowed to participate in the votes or in the work of the Sejm is not my competence.
– said the PiS MP.
When asked what PiS politicians will do if Kamiński and Wąsik cannot participate in the votes, Ast replied that no decisions have yet been made by the PiS club on this matter.
If they occur, they will likely be communicated
– added.
Ast was also asked whether President Andrzej Duda was in a hurry in 2015 when he pardoned Kamiński and Wąsik before the final verdict was handed down.
“He is entitled to a pardon at any stage of the criminal proceedings.
At the time, votes were divided on the president’s prerogative at what stage he could exercise the power of pardon. We share the President’s view that he is entitled to the right to leniency at every stage of criminal proceedings and that he has exercised this right.
– said the PiS politician.
When asked whether President Duda should pardon Kamiński and Wąsik again, he replied that this was the president’s decision.
It is obvious that he has such a legal option, but on the other hand, if he believes that the act of mercy is still valid and extends in time even after the judgment of the court of appeal, he will probably not exercise this right of mercy. grace a second time.
– said the PiS MP.
Yesterday, the Warsaw court, ruling at second instance, legally imposed two years in prison on Mariusz Kamiński and Maciej Wąsik, and one year in prison on the other two former heads of the CBA for operational activities during the “land scandal”.
President Andrzej Duda had previously indicated in a letter to the Marshal that as a result of the application of the pardon law to Kamiński and Wąsik, there was no reason for their mandates to expire.
