On December 15, the Masovian Voivode, Mariusz Frankowski, declared the full resolution of the Otwock City Council of November 15, 2023 on running a cultural institution together with the Ministry of Culture and National Heritage, called the “Institute for the Heritage of the National Thinking,” named after Roman Dmowski and Ignacy Jan Paderewski,” reported the Mazovia press team. This is one of the first decisions of the new voivode. The decision is most likely intended to deprive the Institute of funding in the next step – this was signaled by Marcin Kierwiński.

The Mazovian Voivode itself explained that the Otwock Municipal Council wrongly assumed that the above-mentioned resolution constituted an act of local law.
The Otwock City Council agreed to run a cultural institution together with the Minister of Culture and National Heritage, called the “Institute for the Heritage of National Thought”. Roman Dmowski and Ignacy Jan Paderewski” as a common cultural institution. The resolution in question was adopted at the meeting of the Otwock City Council on November 15, 2023 and delivered to the Mazovia on November 16 of this year. Because the provisions of the resolution raised objections from the Voivode, the municipal council was informed of the start of a monitoring procedure. The supervisory decision was issued on December 15

It was explained that the grounds for invalidating the above resolution include, but are not limited to: incorrect statement by the Otwock City Council that it is an act of local law.
The incorrect classification of the resolution in question as an act of local law led to the incorrect determination of the date of its entry into force. Incorrectly determining the date of entry into force of a decision that is not an act of local law, thereby making its validity dependent on publication in the provincial government gazette, constitutes a significant violation of the law.

The voivode’s press team said that the correct content of the resolution should be consistent with legal provisions, and the procedure for its adoption should correspond to specific procedures.

It should be emphasized that this resolution contains a provision expressing a one-time action, namely permission to run a cultural institution jointly with the Minister of Culture and National Heritage, called the ‘Institute for the Heritage of National Thought’. In addition, in order for a decision to be classified as an act of local law, it must be general, abstract and generally applicable.
