The Subcommittee for the Investigation of the Smolensk Disaster will operate in accordance with the law until August 2024, and the decisions of the head of the Ministry of National Defense Władysław Kosiniak-Kamysz are illegal. That’s probably why we didn’t get any information – Antoni Macierewicz, chairman of the subcommittee, told PAP, commenting on the information about its liquidation.
Withdrawal of the decision establishing the subcommittee
The Ministry of National Defense announced that on Friday, December 15, Deputy Prime Minister and Head of the Ministry Władysław Kosiniak-Kamysz signed a decision, initialed by Deputy Minister Cezary Tomczyk, to revoke the decision establishing a subcommittee of the Ministry of National Defense for the re-investigation of the Tu-154 air accident of April 10, 2010.
The subcommittee is being liquidated and its members are required to dispose of all documentation, real estate and equipment used for the subcommittee’s work by Monday, December 18.

“‘Minister Kosiniak-Kamysz’s position is illegal’
In fact, Minister Kosiniak-Kamysz’s position is illegitimate, which means that he cannot in any way give me decisions that will result in the liquidation of the Subcommittee. The Minister also has no right to decide on the submission of documents and other elements of the subcommittee’s work by the Chairman within four days before the end of the subcommittee’s work. None of the provisions cited by the Minister provide for the possibility of liquidating the Subcommittee before the end of its work, i.e. before August 2024.

He pointed out that “the functioning of the Subcommittee is only specified in the Regulation of the Minister of National Defense, 2016 and there is no provision or facility to wind up the Subcommittee before the expiry of the one-year term of its operation. ”
The 1996 decision only concerns the powers of the Ministry of National Defense, but does not include the power to liquidate the subcommittee

Tomczyk pointed out that from the moment the head of the Ministry of National Defense issued the decision, the subcommittee had no right to undertake “future activities and no obligations.”

No such document was provided to the subcommittee and no information about it was even provided in the media or by telephone. Moreover, our secretary was at the Ministry of Defense office and no one told her anything. Due to the illegal action, it is for the time being only a kind of media propaganda, and from a legal point of view we are dealing with an operation that should be called propaganda-repressive and not legal.

A family member of Kosiniak-Kamysz and Deripaska’s company
As he added: “Everything indicates that Minister Kosiniak-Kamysz is very personally involved in this case.”
I understand him because his relative, the 2009 Deputy Minister of the Ministry of National Defense Kosiniak-Kamysz, played a very important role in the decision that this aircraft instead of the previous company that repaired the Tu-154, went to the company of Mr. Oleg Deripaska, the owner of the Samara factory, close associate of Vladimir Putin and with ties to the secret services. As a result, a Russian company that formally had Polish status, Polit Elektronik, de facto played a key role. This company traded Russian weapons in Poland and other countries previously associated with the Soviet Union. So I understand that this is not just a political problem, but also a personal problem, and that is probably where this illegal behavior comes from.

Macierewicz emphasized that “no official of the Polish state can invalidate the report and cite other material as a valid report.”

Such decisions can only be taken by the chairman of the subcommittee, not by the minister, not by the prime minister, not by the president. There is no such possibility here, so we are faced with a whole series of lawlessness on the part of the current institutions, which obviously cannot be tolerated.

When asked what steps he would take upon receipt of the decision to liquidate the subcommittee, he replied:
If I get a legal position, I will of course implement it. This is absolutely clear, there is no doubt whatsoever. Whatever my political views, the law is the law. It must be implemented.
The functioning of the subcommittee is independent: the President, the Prime Minister or the Minister of Defense have no right to accept or question the report. They neither accept nor deny

It is not possible for Mr Kosiniak-Kamysz, his deputy or even Mr Donald Tusk to question our report, which was adopted in 2021 and published in 2022. In addition, current officials of the Ministry of National Defense claim that the Subcommittee has not published a report stating the causes of the Smolensk disaster. This is a lie and in order to spread it, the report and its attachments have been removed from the Ministry of Defense website. It’s a Soviet operation

He said that this decision is “an obvious step towards Putin, because in this way he will strive that the Smolensk lie will dominate our legal and social life, but this will not happen, let him himself don’t fool around.”

Investigation into the causes of the Smolensk disaster
On April 10, 2010, the crash of the Tu-154M aircraft near Smolensk killed all passengers and crew: 96 people, including President Lech Kaczyński and his wife. The Polish delegation was on its way to the ceremony marking the 70th anniversary of the Katyn massacre.
In 2010-2011, the causes of the Smolensk crash were investigated by the State Aviation Accident Investigation Commission, chaired by the then head of the Ministry of Internal Affairs and Administration Jerzy Miller. In the report presented in July 2011, the commission determined that the cause of the disaster was the descent below the minimum descent height, which resulted in a collision of the aircraft with trees, leading to the gradual destruction of the Tu-154M -structure. According to the Commission, neither the audio recorders nor the flight parameters confirm the suspicion of an explosion on board the aircraft.
However, earlier, in October 2010, members of this committee published a document in which it was clearly stated on page 148 that it is not true that Polish pilots landed and descended too low, which was the cause of the disaster. There it was clearly stated that these Russian positions were false and that there was an obligation to write a new report

The Subcommittee for the Re-investigation of the Smolensk Disaster was established under the regulation of February 4, 2016, signed by the then Minister of National Defense Antoni Macierewicz. The first meeting took place on March 7, 2016.
In April 2022, the head of the subcommittee, Antoni Macierewicz, presented a report on its work, which questioned the Miller Commission’s findings.
The cause of the April 10 disaster over Smolensk was an act of illegal interference by the Russian side on the Tu-154M aircraft with a delegation of the President of the Republic of Poland; The main and indisputable evidence of this interference was an explosion in the left wing 100 meters before the plane passed the birch on Dr. Bodin, over an area where there were no tall trees or other obstacles that could threaten the aircraft. In April this year, the Smolensk Subcommittee submitted a notification to the Prosecutor’s Office on suspicion of committing the assassination of President Lech Kaczyński and the murder of the remaining 95 people who traveled on the Tu-154 on April 10, 2010. And in December this year. The Subcommittee prepared a complaint against Russia to the Court of Human Rights, which clearly defined the cause of the disaster as the result of the destruction of the aircraft by explosions.
The investigation into the Smolensk disaster has been conducted by the prosecutor’s office since April 10, 2010. First of all, it was the Military District Prosecutor’s Office in Warsaw. After the reform of the public prosecutor’s office by the PiS government, the investigation was taken over by the National Public Prosecutor’s Office from the then liquidated military public prosecutor’s office. Since March 2016, the case has been handled by Investigation Team No. I of the National Public Prosecutor’s Office. In 2022, the prosecutor’s office accused Russian controllers of deliberately taking actions intended to lead to disaster. On this basis, the court in Warsaw decided to arrest these Russian controllers. In July this year, the PK announced that the Smolensk Subcommittee’s report on the attack on the President and political elite of the Republic of Poland was included in the investigation.
