Changing the Supreme Court’s rules?
The provisions proposed by the KPRP amend the Rules of Procedure of the Supreme Court. The draft regulation was sent by the President’s Chancellery to the President of the Supreme Court, Małgorzata Manowska, for an opinion.
The proposals contained in the draft amendments to the Rules of Procedure of the Supreme Court, prepared by the Chancellery of the President, envisage a change in the number of judges in the individual chambers of the Supreme Court and a change in the majority needed to pass resolutions of the Supreme Court. In addition, the project includes proposals for regulations regarding the adoption of resolutions by the Supreme Court. The proposed provision changes the number of judges whose presence is required to adopt a resolution in the full court. The provision proposed by the KPRP changes this fraction to 1/2 of the judges, both in the case of resolutions of the full bench of the Supreme Court or the combined chambers, and of individual chambers.
The Rules of Procedure of the Supreme Court are currently in force in the form of a Regulation of the President of the Republic of Poland dated 14 July 2022.
