Adam Bodnar admitted on TOK FM that if he were entrusted with the position of Minister of Justice, he would accept it. In a conversation with Dominika Wielowieyska, he shared his ideas for ‘restoring the rule of law’.
Bodnar suggested firing the judges’ disciplinary prosecutors.
We must take the measures that are possible under these political circumstances. (…) Disciplinary prosecutors can be dismissed, i.e. the trio Schab, Lasota and Radzik, who pursue and prosecute Polish independent judges
– he said. He demanded that all actions be subject to consultation with the judicial community. Was it, among other things, about the Iustitia association?
It can be clearly stated that all actions related to the justice system will be consulted with the judicial community
– he pointed out.
The new senator admitted that there would also be a need for legal changes.
You can also pass whatever laws are necessary to correct the situation of the legal system, while being aware that some of these laws may be vetoed by the president. However, this does not absolve you of the responsibility of preparing and hiring them. (…) I think this is the most important thing for the EC, namely to show that these are not just words, but very specific actions
– he said.
Crawling of judges nominated by the current National Council for the Judiciary
Bodnar presented what fate would befall the neo-judges, as the opposition and judicial circles call those against the reform of the judiciary.
As for the neo-judges, a procedure would have to be carried out or their appointments approved. Here I mainly mean those who graduated from the National School of Judiciary and Public Prosecution, because they had no moral choice to choose the old or the new National Judge. Council of Justice. As for the judges who have opted for the promotion procedure or have decided to become judges under the administration of this new National Council for the Judiciary, their appointment only needs to be approved, but as a result of the reopening of the competitions for this functions. However, this should not affect the validity of the statements
– he said.
And what would Bodnar want to do with the Constitutional Tribunal? “generously” calls for the dismissal of only judges who the opposition considers to be duplicitous.
I am more on the side of the ‘pigeons’ who say that there are only ‘students’, and as for the other judges, we just have to be prepared to wait patiently until there is a majority in the Constitutional Court.
– he said.
