Our opponents demanded censorship, but even the courts of the Third Polish Republic admitted that the Migration Pact included the forced relocation of illegal immigrants. Today it is more than clear to everyone, to me it has always been clear, Prime Minister Mateusz Morawiecki said during a special statement. The Court of Appeal rejected the complaints of FOR and the HFPC, and previously the courts of first instance rejected the claims in which these organizations wanted, among other things: ban on informing about the so-called The Migration Pact is based on the mandatory relocation of illegal migrants. Thus, the courts have granted the right to criticize the EU’s migration policy and relocation mechanisms!
Claims rejected! Morawiecki won in court
The courts at first instance completely rejected the claims of the Civic Development Forum and the Helsinki Foundation for Human Rights, which sought an injunction on saying that the EU relocation mechanism was mandatory; that it concerns illegal immigrants, including those from outside Europe; and also that Poland, by participating in the referendum, can influence the rejection of the migration pact. According to PAP information, the Court of Appeal dismissed the appeals of both non-governmental organizations. They were also confirmed by the representative of PiS and Prime Minister Mateusz Morawiecki, lawyer Adrian Salus.

The head of government referred to the court’s decision during a statement to the media at PiS headquarters at ul. Nowogrodzka in Warsaw.

The Prime Minister also assessed that the war in the Middle East poses a great danger to all Poles, because “Poland is threatened by a huge wave of migration.”

An attempt at preventive censorship
The cases concerned videos that Prime Minister Mateusz Morawiecki posted on Twitter on September 15 and 29. The second was also shared by the PiS profile.
In both cases, the courts unanimously recognized Prime Minister Mateusz Morawiecki’s statements as assessments and advice on, among other things, migration policy. (PO leader Donald) Tusk and Germany. The Prime Minister has not provided false information. The courts in both formations granted the right to criticize EU migration policies and relocation mechanisms. The courts have granted the right to assess that the migration pact imposes coercion and not voluntariness.
On Thursday, government spokesman Piotr Müller, referring to the case on the X platform, wrote that attempts had been made in the last part of the campaign to “block the telling of the truth about the migration package that Brussels bureaucrats are preparing.” He emphasized that this mechanism is coercive: ‘move or pay’.

PiS spokesman Rafał Bochenek announced on Wednesday that both organizations – the Civic Development Forum and the Helsinki Foundation for Human Rights – have submitted applications to the court in the context of a referendum procedure, demanding that Prime Minister Mateusz Morawiecki and Law and Justice be banned to spread what they consider to be false information, including: that the draft EU regulations regarding the so-called The Migration Pact assume the mandatory relocation of illegal migrants. FOR and the HFHR also wanted a ban on the dissemination of information indicating that the so-called The Migration Pact applies to illegal migrants.
The EU migration pact and the Polish referendum
Last Friday, Prime Minister Mateusz Morawiecki took part in an informal meeting of the European Council in Granada, Spain, where one of the topics was the proposed solutions regarding migration to the European Union. The day before, the head of the Polish government, also in Granada, took part in the summit of the European Political Community.
On Friday afternoon, after the informal meeting of the European Council, Morawiecki said he had decided to veto the part on migration, but that there was no such provision in the summit conclusion. He added that he presented a five-point plan to combat illegal immigration, including strong protection of the external borders, fighting human smugglers and cutting off social assistance for illegal emigrants.
On October 15 – the day of the parliamentary elections – a referendum will be held in which the following questions will be asked: ‘Do you support the sale of state assets to foreign entities, which leads to the loss of control by Polish women and men over strategic sectors of the economy?”, “Do you support raising the retirement age, including raising the retirement age again to 67 for women and men?”, “Do you support the removal of the barrier on the border between the Republic of Poland and the Republic of White -Russia?” and “Do you support accepting thousands of illegal immigrants from the Middle East and Africa, in line with the forced relocation mechanism imposed by European bureaucracies?”
