In Warsaw, two Norwegian citizens wanted under European Arrest Warrants were detained for bringing their 5-year-old daughter from Norway, spokesman for the Warsaw District Prosecutor’s Office, prosecutor Szymon Banna, reported. He added that after the interrogation, the Warsaw District Prosecutor’s Office has decided not to take any preventive measures against them.
Prosecutor Szymon Banna, a spokesman for the Warsaw district prosecutor’s office, told PAP that the arrest of two Norwegian citizens wanted by European Arrest Warrants took place in Warsaw on August 9.
A woman and a man are being prosecuted by the Norwegian authorities for taking their 5-year-old daughter from Norway in August 2022 by taking her away from the child welfare service of the district council for child welfare and social affairs in Oslo and Viken in Norway, who decided take care of their daughter and place her in foster care. This is an act based on Art. 261 and art. 15 of the Norwegian Penal Code, which corresponds to Article 211 of the Polish Penal Code

The Norwegian citizen interviewed in this case stated, among other things, that she had decided to live in Poland because she wanted to change her current life. She confirmed that social services in Norway supervised the way she took care of the child, as she grew up in a care home herself

A spokesperson for the Warsaw District Prosecutor’s Office said she had never received any negative comments about the child’s upbringing.
At the time she left Norway, she had no limited parental authority and was not aware of any administrative decisions or court rulings concerning her child

According to the Norwegian side, the child was to be taken from Norway in August 2022, while the prosecution stated that she had legally left Norway alone with the child at the end of September/October 2022. She left alone, without the child’s father, who was already her ex-partner at the time

The prosecutor also stated that the father of the child arrested in the case confirmed the circumstances reported by the suspect.
He stated that he was not aware of court rulings. He recently flew to Poland by plane from Norway on August 2, 2023 and will stay in Poland until his daughter goes to school, because he wants to be present at the ceremony of starting the school year

The Warsaw District Prosecutor’s Office has decided not to apply preventive measures to Norwegian citizens who are being prosecuted by the Norwegian authorities and not to apply for pre-trial detention in court. This is due to an extensive review of the materials gathered in the case

Permanent residence in Warsaw
According to him, the woman and her daughter have a permanent residence in Warsaw.
The defendants unanimously raise concerns about their ignorance of judgments handed down in Norway. Both also state that they are willing to clarify the matter and to cooperate with the prosecutor’s office and the court. In addition, the suspects are not hiding and the child’s father is traveling on the Poland-Norway route and vice versa, most recently on August 2, 2023, so at the time when the search in Norway has already started

At the same time, taking into account the above arguments, the event that is the subject of the case should be analyzed in the further course of the proceedings in the context of the Polish equivalent of the crime under Article 211 of the Penal Code, that is not clear in the subject-subject reality of this case

In view of the above comments, the use of preventive measures was abandoned and it was decided to continue the procedure for the extradition of persecuted persons under conditions of freedom
