Voivodeship Administrative Court in Warsaw at the request of Die Große Kreisstadt Zittau. The Czech and German branches of Greenpeace and the Frank Bold Foundation have taken a decision to halt mining at the Turów mine. In an interview with the wPolityce.pl portal, MEP Anna Zalewska, who is involved in the defense of the Turów mine, emphasizes that PGE will appeal against the decision of the Provincial Administrative Court and that the issues raised by ecologists raised are not relevant.
The Provincial Administrative Court agrees with ecologists’ complaints
Let’s not forget that in February this year the Ministry of Climate and Environment decided to grant a concession for the Turów mine until April 27, 2044. German and Czech environmentalists oppose the exploitation of the mine. According to the inhabitants of Zittau, Germany, the activity of the Turów mine has caused the groundwater level there to drop by 100 metres. Germany also claims that the environmental impact statement prepared by Poland is incomplete and does not take into account the damage caused by the mine abroad. According to them, the procedure for granting mining concessions had no right to end.

The decision fully approved all complaints related to the issuance of environmental decrees, which were submitted when granting concessions until 2026 and then until 2044. It is all the more surprising that the issues raised by these NGOs were absolutely non-substantive, highly emotional. Among other things, they were concerned that whoever causes harm pays – but Turów pays ETS. The issue of damage limitation was raised, and this is what Turów is doing in accordance with all EU regulations, as well as on the German and Czech sides. And finally, that mining must stop, because it risks irreversible changes in the environment

Political and emotional decisions
Anna Zalewska emphasizes that there are emotions on the side of Turów that “again – this time the Polish court will help 60,000. jobs and to the complex, which will provide 8 percent. our energy” – to the complex, which is a guarantee of energy security – “despite complying with all possible regulations”.
Of course, PGE will appeal to the Supreme Administrative Court, but we must be on Turów’s side, monitor this procedure, so that there is absolutely no situation where someone politically or emotionally makes such decisions

Germany bets on coal
All the more shocking is the fact that Germany itself is focusing on extracting energy from coal. In light of the energy crisis caused by the Russian invasion of Ukraine, the German government has taken steps to reconnect a dozen coal-fired power stations and extend the life of several that were due to close. However, the last three nuclear power plants were shut down. Federal Statistical Office data for 2022 clearly indicates that coal and lignite were the main feedstock for electricity production in Poland’s western neighbour. Complaint from the Czech Republic to the CJEU
Let us also recall that at the end of February 2021, the Czech Republic filed a complaint with the Court of Justice of the European Union against Poland regarding the expansion of the Turów mine. At the same time, Prague demanded the application of the so-called interim measure – an order to stop mining. It was found that the mine expansion threatened the access of the residents of Liberec to water, and there were complaints about noise and dust associated with the exploitation of lignite. The Polish government did not comply with orders to stop mining. In September 2021, the CJEU imposed fines on Poland – PLN 500,000. euros a day for the European Commission, for not implementing interim measures and not stopping brown coal mining at the Turów mine.
The mining case was removed from the register of the CJEU in early February 2022 – a settlement was reached between the Czech Republic and Poland that provides for the payment of damages to the Czech Republic in the amount of EUR 35 million and the transfer of EUR 10 million to the Small Environmental Projects Fund
The complex, located at the tripoint of the Polish-German-Czech border, is of fundamental importance to the Polish energy sector.
