In Brussels, one of the EU commissioners gave false information to the media that the law on the Commission for Investigating Russian Influence does not provide for a court appeal. This is not true, Polish ambassador to the EU Andrzej Sadoś told journalists in Brussels.
Sadoś: The EC must first analyze the legislative act and then evaluate it
As Sadoś pointed out, this topic was not discussed at the EU General Affairs Council meeting. He added that he had discussed it with representatives of the European Commission.
I had the opportunity to explain to both Commissioner Reynders and Vice-President Jourova, who in other comments referred to the decisions taken yesterday, that the Commission must first analyze the legislative act, read it and only then evaluate it. Because one of the commissioners this morning gave false information in media statements, including that the regulation does not provide for a court appeal. That is not true
said Sados.
He added that we have to wait until the EC is familiar with the new regulations.
Discussion on the procedure of Art. 7 against Poland
Sadoś also said that there was a discussion on Tuesday in the Council of the EU about the procedure of Art. 7 against Poland.
The Polish side has provided information on the current state of implementation of legislative initiatives. We informed next week on 5 June about the expected ruling of the Constitutional Tribunal. (…) On the EC side, information was presented by Commissioner Reynders and Vice-President Jourova. Nine Western European countries participated in the discussion and asked questions about the level of implementation of legislative initiatives. For the sixth time in the last six years, Poland has provided answers to questions related to judicial reform
- said Sados.
We are particularly concerned about the Polish law on a special committee. (…) The EC will not hesitate to take action on this if necessary
This was said by European Commissioner for Justice Didier Reynders on Tuesday morning prior to the meeting of the General Affairs Council of the EU.
He pointed out that the European Commission is particularly concerned about “the Polish law on a special committee, which can deprive citizens, individuals, of the right to be elected to perform public functions.” He also said such removal would be possible through an administrative decision “without any judicial review”.
This is a particular concern and the European Commission will review the law. The EC will not hesitate to take action if necessary
Reynders noted.
On Monday, President Andrzej Duda announced that he had decided to sign the law establishing a commission to investigate Russian influence on the internal security of the Republic of Poland in 2007-2022 and that he would refer it to the Constitutional Tribunal in 2007 . a follow-up procedure.
On April 14, the Sejm passed the law establishing a commission to investigate Russian influence. They started setting it up in December last year. PiS Delegates. They pointed out that the commission should operate under principles similar to those of the verification commission for the re-privatization of Warsaw.
