Some people associated with the opposition try to outdo each other by linking the shocking case of the death of 8-year-old Kamilek from Częstochowa to the policies of the current government. This step has also been taken by the former Commissioner for Human Rights, Adam Bodnar. “There was a certain atmosphere. The family is the most important thing, the rights of parents and raising children in accordance with their beliefs – even more important. (…) And that has created a certain atmosphere in which we operate and in which the courts also operate,” he said in an interview with TVN24.
“Politicians also play with this currency”
There are ongoing debates over who is responsible for the 8-year-old’s death, and many commentators believe the boy could have been saved, but the institutions were not up to the task.
Former ombudsman Adam Bodnar argued in an interview with Konrad Piasecki on TVN24 that people responsible for decisions such as taking a child away from a particular family do not “feel that if they make such decisions, the state authorities will make sure that they are not criticized for such decisions.
For people to function properly in such a system of social security and crisis intervention, they must act with a sense of absolute confidence in their competences
– he said.
However, the question is what about the institutions who have to make the right decision as they noticed that violence could be used against little Kamil. According to Adam Bodnar, such a “climate” was created by the law on the prohibition of taking children away because of poverty.
Because it is such a difficult decision, politicians also play with this coin. In 2015, the Minister of Justice Zbigniew Ziobro announced that a law would be passed – and it was passed – on the ban on bringing children because of poverty. One story served as a story that children in Poland are taken away because of poverty
– said the former ombudsman.
In this regard, he referred to the statements of the former ombudsman for children, Marek Michalak, who argued that talking about taking children away because of poverty is not true because “most cases involve violence, alcoholism and child neglect”. As if the statistics were taken “from the ceiling” by the Ministry of Justice.
“Family is most important, the rights of parents (…) even more important”
But that is not everything.
There was a certain atmosphere. The family is the most important thing, the rights of parents and raising children in accordance with their beliefs – even more important
Bodner said.
The right to scold children – perhaps not so much in the regulations, but in the words of politicians – is also acceptable. And that has created a certain atmosphere in which we operate and in which the judiciary also operates
he stressed.
It must be admitted that the former ombudsman has shown great ingenuity in combining in this way the terrible tragedy with the policies of the United Right. It is a pity that he does not know or does not want to know that greater legal protection of the family did not mean support for the pathologies that took place in the family of the boy who was tortured by his stepfather.
