On Friday evening, the Sejm was introduced to information about the activities and jurisprudence of the Constitutional Tribunal in 2021. The Tribunal and the absence of the President of the Constitutional Tribunal in the Sejm were criticized by opposition MPs; PiS ruled that the position of the opposition questioning the Constitutional Tribunal was an “anti-state attitude”.
“Strongly anti-state attitude”
On behalf of the club, I must express my understanding for the decision of the president of the Constitutional Tribunal not to participate in the meeting and committee, and the session of the Sejm devoted to the information. We understand this decision
– said MP Marek Ast (PiS). While addressing the opposition deputies, he added: “Previous experience has unfortunately shown that you not only used insulting expressions for the president of the Constitutional Court, but you also questioned its status.”
He judged that the position of the opposition “is a strongly anti-state attitude”.
An institution that works on the basis of laws and the Constitution, a constitutional body of the Republic of Poland, should not be questioned by deputies, because it corrupts the state, and you are doing it for the second term
said Ast. He noted that “hence the absence of the President of the Constitutional Court and possibly other persons who would represent the Tribunal.”
“My club absolutely rejects this report.”
Arkadiusz Myrcha (KO) replied that the scheduling of a debate on this topic “on Friday night, with almost empty parliamentary benches, shows that it is the parliamentary majority that has a contemptuous attitude towards the constitutional court institution.”
How can we talk about a debate on the jurisprudence of the Constitutional Court when in fact there is no such jurisprudence
– added.
Katarzyna Ueberhan (left) also said that “the Constitutional Tribunal does not act and does not judge”.
What a job, such information
she added.
My club absolutely rejects this report. We question a whole series of phenomena emerging in the Constitutional Tribunal, we have been criticizing it for a long time. We believe that we face a major challenge in the near future to fix this extremely important, essential and necessary for the Polish rule of law institution
– emphasized Krzysztof Paszyk (KP-PSL).
Representatives of the Confederation and Poland 2050 circles also criticized the activities of the Tribunal.
During the debate, several opposition delegates asked questions about the situation in the Constitutional Tribunal and the status of the President of the Tribunal, Julia Przyłębska.
I have been informed that the questions that we initially considered rhetorical or asked to each other and to the muses may be answered, because apparently the president will answer questions in writing
– informed the Deputy Marshal of the Sejm Piotr Zgorzelski.
There is no vote in the Sejm on the information from the Constitutional Tribunal.
Earlier – early March of this year. – information on important issues arising from the activities and jurisprudence of the Constitutional Tribunal in 2021 was discussed by the Justice and Human Rights Sejm and Legislative Commissions. Then Marek Ast, who chaired the debate, read a letter received by the committees in connection with the meeting of the Constitutional Court.
The president of the Constitutional Court, maintaining the position expressed last year, will not participate, also by some representatives of the legislature, guided by the need to protect the Tribunal from public undermining of its constitutional position, which violates the rule of law to the scheduled for March 6 this year. joint meeting of the Justice and Human Rights Commission and the Legislative Commission devoted to the information provided to the Sejm by the President of the Constitutional Tribunal on 16 December 2022 on important issues arising from the activities and jurisprudence of the Constitutional Tribunal in 2021.
said the letter Asta had read in March.
That letter, signed by the head of the office of the President of the Constitutional Tribunal, Marcin Koman, added that by providing information on 2021 in December last year, the President of the Tribunal fulfilled the obligation under the law on the organization and procedure before the Constitutional Court.
Unfortunately, the experience of recent years has shown that a factual and substantive discussion of the jurisprudence of the Constitutional Court with the participation of some representatives of the Sejm is often replaced by unprecedented attacks on the Constitutional Court and its judges. The style of debate in previous years has often conflicted with the canon of conversational culture
– it was in the letter read at the time.
