Poland still has to pay €1 million a day for alleged non-compliance with the CJEU’s provisional measure on the disciplinary law of judges. The commission rejected the government’s request not to impose fines. However, the actions of the European Commission are illegal. The subject of the dispute, namely the Disciplinary Chamber of the Supreme Court, was liquidated a year ago.

The EC rejected the request of the Polish authorities to stop imposing a fine of EUR 1 million per day for failing to implement the interim measure of the CJEU related to disciplinary proceedings in the judiciary. In the near future, the Polish authorities can expect the European Commission to withhold a huge amount, even about 150 million euros, as overdue fines, RMF FM journalist Katarzyna Szymańska-Borginon heard in the European Commission

This amount was collected during 5 months, for which the European Commission suspended the sending of payment requests. She did this after Warsaw asked in a letter dated November 3, 2022 to stop imposing fines. Until the EC issued its judgment on the letter and arguments, the calls for penalty payments were suspended. It is normal procedure when we receive such requests so that we can analyze the arguments. Payment requests are then sent again if the Commission determines that the breach still exists, Commission spokesman Christian Wiegand told RMF.

The European Commission has postponed the negative response to the letter of November 3, because it hoped that a new law on the Supreme Court (which should open the way to money from the KPO) will come into force in the meantime. However, as it was stuck in the Constitutional Court – Brussels decided not to wait any longer.
