Hardly anyone expected the European Commission’s insidious attack on Poland at a time when the fate of the KPO funds is officially at stake. This is another phase of the cat-and-mouse game under the guise of concern for the rule of law. When the European Commission, with false promises, forced the Polish government to make far-reaching concessions to the structure of our legal system and the rules of its operation, it turned around again. She has found an obstacle that makes it impossible to start transferring money from KPO to Poland that has been owed to us for over a year.
Unusually, a year and a half after the ruling of the Polish Constitutional Court, the EU bureaucracy suddenly remembered the contents of this ruling and immediately returned with the idea that had initially been signaled in autumn 2021. The head of the European Commission and Commissioner Ursula von der Leyen and Commissioner for Justice Didier Reynders said the ruling of the Polish Constitutional Court raises serious concerns about the primacy of EU law and the authority of the Court of Justice of the European Union undermines. The Commission upholds the fundamental principles of the Union legal order, according to which EU law takes precedence over national law. Therefore, using its powers under the Treaties to protect the principles of uniform application of the law, the Commission has decided to appeal against the judgment of the Polish State Court to the Court of Justice of the EU.
In addition to challenging the 2021 State Court ruling, the EC today expands the claim that the Constitutional Court “no longer meets the requirements of an independent and impartial court previously established by law. This is due to irregularities in the appointment of three judges in December 2015 and in the election of the president in December 2016.”
The decision of the EC to refer Poland to the Court of Justice of the EU in Luxembourg confirms the unchanging strategy of the EC, which is reflected in a stubborn policy to fight the current Polish government, with the aim of replacing it by a government that is willing to support the German vision of European federalization led by Berlin with Brussels as its capital.
In turn, the thread of the incorrect appointment of three judges of the State Court and its President in the request submitted to the CJEU confirms the active, continued participation of the current Polish opposition in Brussels to provide the European Commission of “missiles” aimed at Poland.
