Michał Woś was asked in Telewizja Republika on Wednesday about the controversy within the United Right over the draft amendment to the Supreme Court law, which proponents say should be an important step towards the end of negotiations with the European Union. Commission and the payment of funds to Poland from the KPO.
The deputy chief of the Justice Department stressed that “the unity of the United Right is a great asset”.
As in politics, different emotions rage based on a substantive dispute
– added.
We are in one formation, we form different groups, because we have different sensitivities, different assessments of things, sometimes also fundamental things
noted Wos.
We say that written laws imposed on the Polish parliament by foreign countries have dangerous mechanisms
– added the Deputy Minister. As he said, he read the law himself and asked the opinion of experts.
There was no expert who, after reading this law, did not say that this simply opens wide the great door not to introduce the chaos that these rebellious judges have in some courts (…), but it will mean total anarchy, because everyone will question everyone
said Wos.
According to the State Secretary, a huge part of the project is the transfer of disciplinary cases from the Supreme Court to the High Administrative Court and the questioning of the status of a judge.
How can such a law, which de facto consists of two main parts, be improved? If we give up one or the other, we will de facto scrap this law
– he said.
Guided by the constitutional well-being of the state, guided by the principle of sovereignty, guided by the principle of equal treatment of countries of the European Union, Mrs. (President of the European Commission, Ursula) von der Leyen will not dictate laws in Poland – guided by these principles, we cannot support this bill in this form
– said the politician of Solidarity Poland.
Woś also ruled that no money would come from KPO.
Even if we meet these conditions, more demands will come
he said.
A challenge for Poland
We are just talking about KPO, and we are about to talk about a very big challenge for Poland, i.e. Structural Funds, Cohesion Funds, where unfortunately due to the wrong decisions of Mr (Prime Minister, Mateusz) Morawiecki, we have installed a conditionality mechanism , which is not yet applied
– said the deputy head of MS.
Last week, PiS MPs submitted to the Sejm a draft amendment to the Supreme Court law, which the authors say should complete a major milestone in the KPO case. According to the draft, disciplinary and immunity cases of judges will be decided by the Supreme Administrative Court, and not by the Chamber of Professional Responsibility of the Supreme Court, as is currently the case. The proposed amendment also extends the scope of the so-called test of independence and impartiality of the judge, which can be initiated not only by the litigant, but also ex officio by the court itself. The draft also supplements the exams during the test, with the starting point being the appointment of a judge “under the law”. The bill was due to be considered in the Sejm before Christmas, but was dropped from the chamber’s agenda. His consultations and work on the design of two legislative teams: presidential and government teams were announced.
On Thursday, President Andrzej Duda stated that he had not participated in the preparation of the draft amendment to the Supreme Court law, nor had he been consulted. He called for calm and constructive parliamentary work on the bill. At the same time, he stressed that he would not agree to solutions that undermine the constitutional system and that he would not allow any legal act to be introduced into the Polish legal system that would undermine judicial appointments or allow anyone to verify them.
