Lawyer Jacek Dubois announced on Twitter on Thursday that the court had unlawfully awarded the former head of the Ministry of Foreign Affairs, currently MEP Radosław Sikorski (PO) of PiS president Jarosław Kaczyński, the sum of PLN 708,480 to cover the costs of publishing the apologies on the Onet website.”
The case concerns an interview from 2016, after the election won by PiS, in which the head of PiS referred to the Smolensk disaster and the failure he said the PO-PSL government had committed. In it, Kaczyński assessed that Sikorski had committed diplomatic treason.
Referring to the court’s decision, the PiS spokesperson told PAP it charged an “irrational and wholly inadequate amount.”

As he added, in accordance with practice, the court should suspend the execution of this ruling until the case is resolved before the Supreme Court.

Sikorski’s trial
In December 2016, a lawsuit was filed in court in which Sikorski demanded an apology from Kaczyński for words from interviews that, according to the plaintiff, violated his good name, honor and dignity. For example, I know more about how the Miller’s commission operated – which was also demonstrated by the subcommittee of Antoni Macierewicz’s experts by publishing recordings showing that the previous government acted under the dictates of the Russians. There were more such incredible activities. Deputy Ambassador to Moscow, Piotr Marciniak, submitted a note on the extraterritoriality of the crash site. He was then ordered to withdraw it. This was a move ordered by Radosław Sikorski, but without Tusk’s knowledge? There is already a very serious penal code provision here: diplomatic treason.”
In June 2018, the Warsaw court ruled that Kaczyński did not have to apologize to Sikorski for his statements attributing “diplomatic betrayal” to him in connection with the actions following the Smolensk disaster. The court of Warsaw has definitively rejected the claim of the former head of the Ministry of Foreign Affairs. The court then ruled, among other things, that Kaczyński’s statements “fell within the legally permissible limits of criticism, the scope of which is much wider in relation to public figures than to private persons.”
In July 2020, after considering the appeal, the Warsaw Court of Appeals amended the verdict, ruling that Kaczyński violated Sikorski’s personal rights and required the head of PiS to publish an apology. An appeal in cassation has been lodged against this court decision with the Civil Chamber of the Supreme Court.
