GIrona Court issued a dictation search and capture order with international scope to locate a suspect accused of rape involving a 13-year-old girl in Cassà de la Selva, Girona, between December 2021 and January 2022. The individual was scheduled to face trial in the third chamber on a Tuesday, but did not attend. As a result, the court moved to activate the decision. Following the arrest, a detention hearing is planned to determine whether the suspect should remain in custody until the trial date.
The alleged events occurred from late 2021 through January 2022, when the victim was 13 years old. The defendant was described as a family acquaintance who visited the girl’s home on multiple occasions and engaged in inappropriate touching, exploiting the girl’s isolation. On February 19, when the victim was alone, the man returned to the home and invited her to sit with him on the couch. She refused, but he approached her and, unable to defend herself, committed rape.
Three sexual offenses
About a month after the incident, the girl reported severe abdominal pain accompanied by vomiting and sought medical care at CAP. A pregnancy test returned positive, and she subsequently received abortion treatment. The allegations implicate the defendants in two counts of sexual abuse and a count of sexual assault by penetration, with prosecutors seeking a prison term of up to 21 years. The state also requests compensation of 30,000 euros to the minor for damages and seeks restrictions on the individual’s employment in roles involving contact with minors for 15 years. Additionally, custody rights are proposed to be suspended for 10 years. If convicted, prosecutors request dismissal from custody once three-quarters of the sentence have been served. The defense has denied the charges and seeks acquittal for the defendant.
