The victim was 13 years old. The prosecutor stated in the indictment that the defendant’s long-standing friendship with the family had helped create an atmosphere of trust, which the defendant exploited to gain access to the minor.

The minor’s family testified that the accused invited the girl under the pretext of giving her a massage because he was employed by the family. He then summoned the girl to his residence in Palma. What began as a lumbar massage progressed into touching of the girl’s breasts in what was described as a sexual mood. The initial contact occurred over her bra, and the accused urged the child to remove it under the pretext of examining her physical development.

According to the proceedings, the masseur signaled the girl to lower her pants and engaged in touching her groin and genitals while keeping the encounter private and controlled. The misconduct reportedly occurred multiple times in a single session at the victim’s home, with the assailant later touching his own genitals in the presence of the girl. At one point the girl was asked to lift her shirt so he could view her breasts.

As a direct consequence of the alleged sexual abuse, the minor has shown signs of acute stress and has undergone psychological treatment since November 2018. Court records indicate that the case prompted ongoing concern for the child’s mental health and development, leading to continued professional support after the events.

Initially, the prosecutor had sought a twelve-year prison sentence for the accused for allegedly abusing a child under sixteen. However, after a compliance agreement reached during the proceedings, the requested term was reduced by half. The verdict delivered in court on Wednesday is described as a formal disposition pursuant to the agreement reached by the parties. The judgment also imposes a ten-year ban that restricts the defendant from approaching within 200 meters of the victim and imposes additional supervised liberties commonly attached to such cases. Prior to the trial, the accused had already transferred 6,000 euros, representing half of the civil liability charged by the prosecution.
