In September, the Torrevieja Instruction Court No. 2 ordered the start of an oral hearing before a popular jury. Wayne Patrick W.’s defense attorney, Francisco Miguel Galiana Botella, asked the investigative body to document the death and circumstances of Simon Mark F., who had become known in Irish media, even though the death itself was not of violent origin. Although extradition did not take place, Simon testified via video conference from Ireland and denied involvement in the crime.

He was a 36-year-old compatriot who had recently passed away in Ireland. The defendant is Wayne Patrick. After visiting several bars in Torrevieja, Carl Aidan Carr and Simon Mark F. went to the house with three other women. One of the women had been a former partner of Wayne Patrick W. and had sexual relations with Carl at the home. Simon learned of this and went to a bar in Orihuela Costa where Wayne was, informing him of what had happened.

The two defendants went to the Torrevieja property and attacked Carl Carr in what the court described as an act of revenge, intending to kill him. They stabbed him multiple times and struck him in the face repeatedly with brass knuckles. According to the judicial verdict, Carl Carr died from complex facial fractures caused by multiple traumas.

Transportation of the body

After Carl Carr died, the two involved called a person accused of helping to cover up the incident. They cleaned the house to wipe away the blood and moved the body to a plot in Rojales near the CV-920 highway, concealing the crime. The car used to transport the body, Wayne’s property, was kept at his home by one of the alleged accomplices to avoid discovery.

One of the women on trial, who has been referenced as the malevolent excuse for Wayne Patrick, claimed to have been at a bar in Orihuela Costa with him that night and later slept at her home, leaving the next afternoon. The Prosecutor’s Office contends this account is false and asserts that Wayne had already left the bar with Simon Mark.

Regarding Wayne’s ex-girlfriend, who is accused of theft, the court noted that Wayne lied in his statements to shelter the alleged killer and eventually admitted to staying at the victim’s house to sleep there. They allegedly had sexual advances with Carl Aidan Carr, while the prosecution claims he was present when Wayne and Simon arrived at the house and subjected Carl to aggressive berating, prompting Carl to leave, with his former partner urging him not to speak.

The latest person accused of helping to cover up the case lied in their initial statement, claiming Wayne’s former partner had accompanied him to his mother’s house. They later admitted that all parties broke into La Siesta’s home and that the alleged killer’s former partner stayed behind when he left, the court heard.

Wayne Patrick is also charged with illegal possession of weapons due to a 9 mm Parabellum caliber HK pistol with an erased serial number and eleven cartridges found inside.
