Investigation in Arganda: Review of Procedural Steps and Alleged Rights Violations

In Arganda del Rey, Judge number 9 is reviewing the legitimacy of certain actions within the ongoing investigation. Several individuals faced charges related to manslaughter under circumstances of vulnerability and procedural violations.

The actor and his spouse remain under scrutiny as suspects in the death of María Isabel. The autopsy indicated cadmium and manganese levels that exceeded normal ranges, prompting further examination of the circumstances surrounding the case.

Defense counsel for the investigators submitted a brief to the judge last Thursday. They requested a voluntary declaration from the couple and asked for parts of the proceedings to be annulled on grounds of fundamental rights violations.

Specifically, the request targets the extension of proceedings carried out by the Civil Guard in June. It concerns the questioning of relatives and people in Palomino’s circle, which has been described as having a tense atmosphere. The defense argues that these statements were obtained with the defense of Luis Lorenzo and Arantxa Palomino present and could have left them without adequate representation.

Additionally, the defense claims that Article 416 of the Code of Criminal Procedure (YÖK) was violated in relation to interrogating close relatives, arguing that it exempts certain relatives from declaring their connections in court. The provision covers spouses, partners in de facto unions, close kin up to the second degree, and others connected by kinship, safeguarding due process for those involved.

The attorney stated to Europa Press that the interrogations occurred within the judicial process yet might have contravened the principle of contradiction, potentially infringing fundamental procedural rights.

Meanwhile, the Civil Guard’s Criminalistics Service Environment Department reported that no cadmium was found in the samples taken from the actor’s home. A voluntary statement will be requested before the judge at the residence of the couple.

According to Europa Press, the samples were collected at the couple’s home on Luis García Berlanga street in Rivas-Vaciamadrid, the site linked to María Isabel’s death. The report concluded that no cadmium appeared in any tested sample; however, manganese was detected in several items, including batteries, unlabeled liquid bottles, and paint containers.

The items involved included medical documents tied to the deceased and everyday objects such as batteries, paint cans, unlabeled medicine bottles, and clear liquid bottles. The autopsy concluded death resulted from heavy metal poisoning, noting cadmium levels in oil-based paints at approximately 200 times the normal limit and manganese levels in batteries and similar items around twenty times the standard concentration.
