A man of Algerian origin, aged 28, was found guilty of assault within a gender-based violence framework and was sentenced by the Castellón District Court. He received a sentence of one year, three months and one day in prison, accompanied by 40 days of community service to benefit society.
The incidents leading to the lawsuit occurred in November 2021 in Orpesa, where he lives with his partner.
In the courtroom, the court established a dynamic in which the defendant, both victim and aggressor in the dispute, reacted poorly when his actions were misinterpreted. He grabbed his partner’s mobile phone and a confrontation ensued over the device.
During the altercation, the man pushed her onto the bed, positioned himself over her, and grabbed her neck. He then used a hair straightener, securing the plug’s cord around the woman’s neck and pulling the ends to exert control, described in the sentence as a moment when male dominance was asserted for a few seconds.
Afterward, the man left the home, closed the door twice, and left the victim inside without a key. With assistance from the Orpesa Local Police and agents, the victim managed to exit and alerted the authorities.
As a consequence of these events, the woman suffered abrasions, superficial wounds, and anxiety, requiring first aid and a seven-day recovery period. During this time, she was unable to resume her usual activities.
Before the celebration of the judgment, the defendant acknowledged responsibility for the injuries and damages, and the court noted a sum of 3,550 euros as compensation. A prior agreement with the Prosecutor’s Office and the defense led to the defendant admitting the facts and accepting the sentence, including a prohibition on possessing or carrying weapons for three years. The court also considered a restraining order to prohibit the defendant from approaching or contacting the former partner within 500 meters for five years.
Support resources for abuse survivors
In cases of abuse, there are confidential channels designed to provide immediate guidance and assistance. Helplines are available around the clock, every day of the year, offering information, safety planning, and access to local services. The aim is to ensure survivors can reach help without incurring costs or exposing themselves to further risk. These services emphasize privacy and prompt response, helping victims understand their options and rights within the legal system. The role of such resources is to connect individuals with professionals who can assess danger, arrange safe housing when needed, and outline steps toward protection and recovery. Support networks may include social workers, counselors, and legal advocates who work together to coordinate care and safety plans for those affected by gender-based violence.
Authorities encourage reporting violence early and seeking assistance through approved channels, which can provide continuity of care, documentation for future proceedings, and interim protections if required. Survivors are urged to document injuries and keep records of any threats or coercive behavior, as these elements often influence court decisions and support services. A coordinated approach among police, prosecutors, and domestic violence programs helps ensure timely interventions and a safer environment for those affected.
Cited authorities also stress the importance of social support, including counseling and community resources, to help survivors rebuild confidence and regain a sense of security. While legal consequences may reflect accountability for the acts committed, the broader goal remains safeguarding the well-being and autonomy of victims, enabling them to move forward with dignity and resilience. Marked summaries and official communications often accompany court decisions to provide clear explanations of what occurred, why the sentence was determined, and which protective measures are in place.
