The Florida grandfather, now 65, was put back in custody on April 17 after a judge previously overturned a wrongful conviction on which his imprisonment was based.
In the initial 1990 trial, he was found guilty of murder and faced a death sentence, but the conviction was nullified in 2018. He was released in April 2021 after serving decades in prison. Yet the state pursued a new appeal that overturned that release, ultimately restoring the earlier judgment and returning him to confinement last year. This sequence left unresolved questions about the process and the accuracy of the initial verdict.
Speaking about the years outside prison, the man described a period of profound personal transformation. He spoke of reuniting with his family, meeting his grandchildren for the first time, and learning a trade he now loves. He described engaging in his church community, pursuing new relationships, and hoping to spend his remaining years in freedom and peace. The case traces back to 1989 when a Florida resident was arrested in connection with the death of a 22-year-old man. At the time, the victim’s former girlfriend told authorities she had been abducted by a Black man, and a photo lineup was used to secure an identification that led to a life sentence. No substantial physical evidence tied the defendant to the crime, yet a Black man was charged with kidnapping, robbery, and murder. Later, it emerged that the deceased’s daughter herself was suspected of involvement in the crime.
During the trial, held more than three decades ago, the defendant entered a not guilty plea and, after a jury that was all White, a death sentence was imposed. Over time, errors in the sentencing process were revealed, and lawyers successfully argued for the defendant’s release from death row.
A February court ruling in the United States subsequently found the man not guilty after nearly 30 years of incarceration and legal contention, underscoring the persistence of questions around the conviction and the steps taken to rectify it.
