They described that, according to the police report, the accused, now in custody, spontaneously stated that he had given his daughter pills dissolved in cola because he did not want her to be with someone he described as a molester. The prosecutors, including the special prosecutor and the family attorney, asserted that the custody decision favoring the father is a key moment in the sequence of events, suggesting the father intended to end his own life to prevent Olivia from living with him. The statement was shared outside the Palace of Justice on Monday by Ignacio Blanco, who represents the special prosecution, alongside Daniel Labrador, the family lawyer.

In the courtroom, Carolina Montero, head of Investigation Court No. 1 in Gijón, oversees the case as it unfolds. The doctor and the two agents who rode with the mobile intensive care unit attended, one in the vehicle and one in the police car, to confirm their roles in the early medical care. The prosecution’s account, provided by Eugenio García on behalf of the minor’s father, describes the person under investigation as conscious during hospital care. The witnesses indicated that the declaration was made with the intention of ensuring Olivia would not live with her father. They noted that Olivia did not ingest a dose that would have posed an immediate risk to her life, and that there was no stomach pump administered in the hospital. The doctor was described as having a careful and brief involvement, and the witnesses expressed positive assessments of the work done that day. The testimony there was said to move between focused attention and reflective quietness.

Lawyers reinforced on Monday that the dose of the medication given to Olivia was, in their view, lethal. A forensic officer, citing the clinical analysis, indicated that the detected levels of Lozarepam would be fatal for a minor, with a concentration higher than the critical thresholds observed in the blood. The assessment suggested that the dose was sufficient to cause Olivia’s death, according to the forensic interpretation presented to the court. The forensic conclusion was presented by the prosecution as a decisive factor in determining the cause of death related to the medication.

Meanwhile, additional statements from National Police officers are anticipated in the coming days as part of the ongoing inquiry. Prosecutors also expect the final autopsy results and an examination of mobile devices from the moments preceding the incident. The legal team stressed that prompt, thorough work is underway and that a reviewable, permanent prison term could be sought for Noemí Martínez Largo for the alleged murder of Olivia. The investigation continues to broaden its scope to ensure all relevant evidence is reviewed.

The detainee is currently held at the Asturias Prison Centre, under guard and with suicide prevention procedures in place. Reports indicate that Martínez Largo lives a routine life within the prison setting. Since her arrest, she has repeatedly invoked her right not to testify about the alleged acts, except for a spontaneous remark made to reporters outside the facility. At this stage, no forensic examination has been ordered to assess her mental state or full imputability. It is anticipated that procedures related to mental health evaluation and other diagnostic steps will begin once witness statements are collected and the autopsy findings are finalized.
