A court in Elche has handed down a prison sentence for the truck driver involved in a car accident in which Elche’s former mayor and adviser to Diputación Sergio Rodriguez died, as confirmed by sources close to the case. The truck driver was arrested by the Civil Guard after testing positive for cocaine.

The accident occurred around 6 pm on Monday afternoon, after the truck and Rodriguez’s vehicle collided head-on, and Rodriguez died before his medical services could do anything to save him.

Alicante Civil Guards arrested the driver of a car, who was involved in the accident that claimed his life, last Monday, when the drug test was positive. The Guard and Instruction Court ordered him to be admitted to prison, the command reported.

On Monday, August 1, at approximately 18:05, the Civil Guard, via the 112 emergency number, learned of a traffic accident that occurred at the 1,400 kilometer point of the CV-854 road in the municipal area from Elche.

A team of witnesses from the Alicante Traffic Sub-Sector immediately went to the scene and observed how a truck and car collided head-on at the scene.

Agents specializing in the investigation of traffic accidents, after collecting the data and examining the location, concluded that the truck driver had crossed into the opposite lane while driving a neighbor’s car from the town of Elche in front of him. This resulted in a head-on collision. Given the severity of the accident, the truck knocked over part of a wall near the road after the initial impact.

The driver of the vehicle could not avoid the collision due to the type of road and the unexpected maneuver performed by the truck driver.

After testing the 45-year-old truck driver to detect alcohol and drug use, he tested positive for drug use. The body of the other driver was released while this test was being carried out.

At the scene, agents continued to arrest the truck driver accused of reckless manslaughter and road safety offenses for driving under the influence of drugs.

Later, the health services transferred the detainee to Elche General University Hospital and left him in police custody until last Wednesday.

After medically discharged, the Elche Tribunal of Duty and Instruction ordered the applicant’s imprisonment and immediate reinstatement of his license. In addition, the vehicle used by the detainee was also judicially intervened.

The counteranalysis report conducted by the Institute of Toxicology confirmed that the detainee had been using drugs prior to the incident, which is one of the relevant tests for possible criminal liability of the driver.

Likewise, the team of reports from the Alicante Traffic Subsector continues to investigate to expand on the evidence that could explain why the detainee occupied the opposite lane.

Rodriguez was chair of the communications cabinet of Elche City Council between 2011 and 2015. Between 2018 and 2019 he was a councilor of the PP at the Elche Consulate. He was also in charge of New Generations of Elche.

He still worked as the deputy coordinator of the PP in the Provincial Assembly and was the deputy provincial secretary of the People’s Party Communications.
