He reminded that the trees planted behind the fence, that is, on the municipal land or in the common use area, are not considered the property of the summer cottage, therefore, according to the law, anyone can pick fruit from them. According to lawmakers, there are frequent cases when the owners of the summer cottage planted a fruit tree behind the fence, and then the neighbors were offended by the spoiling of the harvest.
“Even if you planted cherries or raspberries behind the fence, by law anyone can pick berries from the trees because this is no longer your land,” Chaplin said.
He also reminded that it is the responsibility of the owners of individual residential and garden houses to care for the territory adjacent to the fence. As a result, it turned out that the land behind the fence does not belong to the summer resident, but he should especially watch it so that there are no parsnips on it.
