The State Duma proposed canceling fines for being late for work due to bad weather 09:41

Disciplinary penalties against employees who are late for work due to bad weather should be prohibited in Russia. State Duma deputy Ivan Sukharev made such a proposal in a letter addressed to the head of the Ministry of Labor Anton Kotyakov: transmits RT.

He reminded that according to the Labor Law, employers can impose disciplinary sanctions, including reprimands and reprimands, against employees who are late without a justified reason. If an employee receives two such penalties within a year, management may terminate the employment relationship with him.

The deputy added that so far in the labor legislation there are no criteria that can determine the degree of guilt of an employee for being late due to force majeure due to weather conditions. It also does not define what types of severe weather conditions will be considered a valid reason for being late.

“In this regard, I ask you to consider the advisability of including in the regulatory legal acts a provision on the impossibility of imposing a disciplinary penalty if an employee is late due to difficult weather conditions that significantly change the public transport schedule, and also, for example, from the Ministry of Emergencies, municipal transport organizations etc. “Also consider the issue of defining arrangements for verifying explanatory notes, such as the use of explicit information received,” Sukharev’s objection text reads.

Honored Lawyer of Russia Ivan Solovyov previously aforementionedIf an employer initiates disciplinary action against an employee who is late due to bad weather conditions, the reprimand may be appealed because the employee was not actually at fault. He recommended that his journey from home to work be filmed to prove his innocence. The lawyer concluded that these video recordings could be taken to court if the administration refuses to appeal the condemnation decision.
