Russians who return money after a transfer from a foreigner may become accomplices in fraudulent schemes. This situation was reported to the agency “Hit the primer” Petr Gusyatnikov, senior managing partner of law firm PG Partners.
As the lawyer explains, scammers may want to transfer money to a different account, phone number or details for themselves. They use a similar scheme to confuse the transfer chain.
In such a case, it is safer to apply to the bank to request that the money be returned to the account from which it came. He also noted that when a transfer message arrives, you need to make sure that the money has actually reached the account, because sometimes fraudsters send SMS from a similar bank number using IP telephony.
According to Gusyatnikov, you should not return the money or seize someone else’s property without even checking whether the account balance has changed. He stated that anyone who made a mistake and transferred money can apply to the court within 3 years and demand the recovery of this amount as unjust enrichment, and the court will most likely side with him.
