The Supreme Court will evaluate the case of freezing transfers abroad for the first time

The Supreme Court of the Russian Federation will consider for the first time the dispute between the company IS TEKS and the legal successor of MInBank (Promsvyazbank) due to the blocking of funds during international transfer. This was reported by “Kommersant”.

In March 2022, İŞ TEKS instructed Moscow Industrial Bank to transfer 59.4 thousand dollars to Kazakhstan to pay for the goods. However, on May 6, MinBank fell under US sanctions and American bank BNY Mellon blocked the transfer.

İŞ TEKS applied to the court, stating that MINBank violated the transfer conditions by changing the intermediary bank. Three lower courts collected 59.4 thousand dollars as compensation from the bank in favor of the company.

PSB, which became the legal successor to MinBank, filed a complaint with the Supreme Court, claiming that it acted in accordance with established settlement practices and failed to foresee sanctions.

According to lawyers, the outcome of the case will be important for many companies and individuals whose funds have been blocked due to sanctions imposed on Russian banks.
